AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING ORDINANCE NO 84-
117 TO PROVIDE FOR A CHANGE IN THE CONCEPT PLAN FOR THE PLANNED
DEVELOPMENT (PD) NO 83 ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION AND PROVIDING FOR APPROVAL OF A DETAILED PLAN ON 0 472
ACRES, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR
VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Jeffrey Bacon, on behalfofV J D Incorporated, has apphed for an amendment
to the concept plan set forth in Ordinance 84-117 for 0 472 acres of land an planned development
(PD) No 83 zomng district classlficataon and use desagnatlon, and
WHEREAS, on April 8, 1998, the Planmng and Zomng Commission, at, er a pubhc heanng,
recommended approval of the requested changes, and
WHEREAS, the Caty Cotmml finds that the amended concept plan and proposed detmled
plan wall be an comphance wath the Denton Development Plan and Denton Plan Pohcaes, NOW
THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That Orrhnance No 84-117, prowdmg approval of a planned development
dastnct for 15 8 acres of land as described thereto, as hereby amended by approval of a revased
concept plan and approval of a detailed plan on 0 472 acres for planned development dastnct No 83,
as described m said detailed plan attached hereto as Exh~bat "A", incorporated herem by reference
The property thereto deacnbed shall be constructed, used, and mmntatned an accordance wath the
approved detmled plan
SECTION II. That the prowsaons of this ordinance as they apply to the 0 471 acres shown
an the detmled plan hereto approved, shall govern and control over any conflmtlng provasaon of
Ordmanee No 84-117, but all the provaslons of Orchnance Nos 84-117 and 89-024 as they apply
to that rema~mng portion of the dastnct not herem amended, shall contmue in force and effect and
shall apply to the remainder of the district
~ That a copy ofthts ordinance shall be attached to Ordanance Nos 84-117 and
89-024, showing the amendment hereto approved
~ That any person vlolatmg any provision of this ordinance shall, upon
convlctmn, be freed a sum not exceeding $2,000 00 Each day that a prowsaon of this ordanance is
violated shall eonstatute a separate and distanct offense
~ That this ordinance shall become effective fourteen (14) days from the date
of ~ts passage, and the Caty Secretary as hereby darected to cause the capUon of flus ordinance to be
pubhshed twice an the Denton Record Chrom¢le, the official newspaper of the C~ty of Denton,
Texas, within ten (10) days of the date of its passage
