AN ORDINANCE PARTIALLY VACATING A CERTAIN UTILITY EASEMENT
RECORDED IN THE PLAT RECORDS OF DENTON COUNTY, TEXAS AT VOLUME 3,
PAGE 51, AS IT PERTAINS TO LOT 16, BLOCK 18 OF THE SOUTHRIDGE ADDITION,
AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the City of Denton has received a request for the part~al abandonment of a
certmn utility easement, and
WHEREAS, the Plarmmg and Zoning Commission of the C~ty of Denton, Texas
rewewed the requested abandonment and recommended approval, and
WHEREAS, the Council of the C~ty of Denton, Texas has determined that the utthty
easement being parUally vacated ~s no longer needed for pubhc use, and
WHEREAS, the fatr market value of the utthty easement has been determined and
received, as reqmred by Section 272 001 of the Texas Local Government Code and DENTON,
TEX, CODE ch 2art IV (1991), NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS
~ That the port~on of the utility easement described in Exhlbtt A, attached
hereto and mcorporated hereto by reference, and recorded ~n Volume 3, Page 51 of the Plat
Records of Denton County, Texas, as ~t pertmns to Lot 16, Block 18 of the Southndge Addition,
is permmaently vacated and extmgmshed as a public easement, to the extent described m said
exhibit
~ That by reason of such vacation the C~ty of Denton's property interest in
the vacated portion of smd easement shall, by operations of law, revert to the owner or owners
abuttmg the easement here~n abandoned, and the City of Denton releases any and all claims to
the use of the vacated portton of smd property as a pubhc easement
~ That this orchnance shall become effective lmmedmtely upon Its passage
and approval
