ADDITION, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the C~ty of Denton has received a request for the part~al abandonment of a
certmn sanitary sewer easement, and
WHEREAS, the Planning and Zoning Commission of the C~ty of Denton, Texas
reviewed the requested abandonment and recommended approval, and
WHEREAS, the Council of the City of Denton, Texas has determined that the samtary
sewer easement being partially vacated is no longer needed for pubhc use, and
WHEREAS, the fmr market value of the sanitary sewer easement has been determined
and received, as reqmred by section 272 001 of the Texas Local Government code and
DENTON, TEX, CODE ch 2 art IV (1991), NOW THERFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I. That the portion of the samtary sewer easement described ~n Exhibit A,
attached hereto and incorporated herein by referenced, and recorded ~n Volume 457, Page 375 of
the Deed Records of Denton County, Texas, as it pertains to Lot 6, Block A of the Sherman Oaks
Addition, an addition to the C~ty of Denton recorded ~n Cabinet N, Page 110 of the Plat Records
of Denton, County Texas, ~s permanently vacated and ext~ngmshed as a pubhc easement, to the
extent described ~n smd exhibit
~ That by reason of such vacation the City of Denton's property ~nterest ~n
the vacated port,on of said easement shall, by operation of law, revert to the owner or owners
abutting the easement herein abandoned, and the C~ty of Denton releases any and all claims to
the use of the vacated port~on of smd property as a pubhc easement
~ That th~s ordinance shall become effective ~mmed~ately upon its passage
and approval
