AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING ORDINANCE NO 86-81
TO PROVIDE FOR A CHANGE IN THE CONCEPT PLAN FOR THE PLANNED
DEVELOPMENT (PD) NO 111 ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION AND PROVIDING FOR APPROVAL OF A DETAILED PLAN ON 45 139
ACRES, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR
VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Carter and Burgess, on behalf of Tamberglen Company, has apphed for an
amendment to the concept plan set forth an Ordinance 86-81 for 131 76 acres of land ,n planned
development (PD) No 111 zomng dastnct classaficaUon and use desagnataon, and
WHEREAS, on April 22, 1998, the Planmng and Zoning Commassion, after a pubhc hearing,
recommended approval of the requested changes, and
WHEREAS, the Caty Cotmeal finds that the amended concept plan and proposed detailed
plan wall be m comphance with the Denton Development Plan and Denton Plan Pohcaes, NOW
THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That Ordinance No 86-81, provadmg approval of a planned development
dastnet for 131 76 acres of land as described thereto, as hereby amended by approval ofa revased
concept plan and approval of a det~uled plan on 45 139 acres for planned development district No
111, as clesenbed m saad detmled plan attached hereto as ExahJbat "A", incorporated hereto by
reference, The property, deacnbed m Exhabat "B", shall be constructed, used, and mmntamed an
accordance with the approved detailed plan
SECTION II That the provlsaons ofthas ordinance as they apply to the 45 139 acres shown
in the det~uled plan hereto approved, shall govern and control over any conflactang provision of
Ordinance No 86-81, but all the prowsaons of Ordinance Nos 86-81 as they apply to that remaining
portaon of the dastnet not hereto amended, shall continue m force and effect and shall apply to the
remainder of the thstnet

showmg the amendment hereto approved
~ That any person wolatmg any prov~saon of thas ordanance shall, upon
convacUon, be fined a sum not exceeding $2,000 00 Each day that a provasaon of thas ordanance as
wolated shall constatute a separate and dastmct offense
SECTION V That flus ordinance shall become effectave fourteen (14) days from the date
ofats passage, and the Caty Secretary as hereby darected to cause the capUon of thas ordinance to be

Texas, within ten (10) days of the date of its passage
