EFFECTIVE DATE (PSA # 2164 - ADDENDUM #2 - TEAGUE NALL AND PERKINS IN THE
AMOUNT OF $18,200 00)
WHEREAS, on July 1, 1997, the City entered Into a Professional Services Agreement for
the design of stream PEC-4 Storm Drmnage Improvements and Ruddell Street Bridge and Channel
Improvements with Teague Nail and Perkins, Inc, hereinafter referred to as "Base Agreement," for
a not-to-exceed amount of $217,647, and
WHEREAS, on December 11, 1997 the Council authorized addendum #2 increasing the
consultants not-to-exceed figure by $45,163 00 to $262,810 and,
WHEREAS, the C~ty desires to expand the scope of work for the above named consultant
to ~nclude Addendum #2 and to increase the consultant's not-to-exceed figure by $18,200 to
$281,010 00, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the City Manager ~s hereby authorized to execute Addendum #2 to the
Base Agreement between the City and Teague Nail and Perkins, In substantially the form of the
attached Addendum #2, wluch ~s made a part of flus ordinance for all purposes
~ That the C~ty Manager is hereby authorized to expend the funds as set forth
m the aRached Addendum #2.
~ That flus ordinance shall become effective munedxately upon its passage and
approval.

Tlus Addendum No 2 to that Professional Services Agreement for the design of stream
PEC-4 storm drainage unprovements (Pecan Creek to P&P Rmlroad) and Ruddell Street bridge
and channel nnprovements (Ruddell Street to Stream PEC-4) between the City of Denton, a Texas
Mumclpal Corporation, with its principal office at 215 East McKmney Street, Denton, Denton
County, Texas 76201, (hereinafter sometimes referred to as "Owner") and Teague Nail and
Perkins, Inc, with Its corporate office at 915 Florence St, Fort Worth, Tarrant County, Texas
76102, (h~relnafter sometnnes referred to as "Consultant"), acting herem by and through their
duly authorized representatives, hereinafter referred to as "Base Agreement"
ARTICLE I.
That Section B of Article II "Scope of Services" of the Base Agreement IS hereby amended
by adding (Items 1 and 2) and deleting (Item 3) the following engineering services for the
referenced elements of the project
1 Preparation of three (3) Nationwide 404 penmt applications and one (1) individual 404
permit apphcation for various segments of the subject project as required by the Corps
of Engineers (COE) Also included m these services will be coordination with COE,
attendance at pre-submittal meetings with both the City of Denton and COE, and the

subrmttal of these 404 perrmt apphcations with related rmtigauon plans as necessary
Permit submittals will be based on the pre-submittal meetings and will address C~ty
and CeE comments Specifically excluded from flus proposed contract amendment
fee xs the effort necessary to respond to any CeE comments after submittal
2 Preparation of boundary surveys and required easements for the area between
Woodrow and Ruddell
Delete preparation of tlurty (30) easements along the project route previously included
m the scope of servlcas of the original contract agreement
ARTICLE H.
That Article V "CompensaUon," subsecUon B "Bdlmg and Payment" of the Base Agreement
~s hereby amended by adding/deleting the following fees to the Consultant's not-to-exceed fi~ure

That save and except as amended hereby, the remalmng sections, subsections, sentences, and
phrases of the Base Agreement shall remain in full force and effect
