1998-141AN ORDINANCE AMENDING THE 1997-98 ANNUAL RECREATION FUND BUDGET OF
THE CITY OF DENTON IN THE AMOUNT OF TWENTY-ONE THOUSAND FIVE HUN-
DRED NINE DOLLARS ($21,509 00) TO HELP ESTABLISH THE MIDDLE SCHOOL
PROGRAM AND EXPENDING SUCH FUNDS FOR RECREATIONAL PROGRAMMING
AT THE THREE MIDDLE SCHOOL SITES, AND PROVIDING AN EFFECTIVE DATE
WHEREAS, after the 1997-98 C~ty budget was adopted, the Denton Independent School
Dtstnct ("DISD") requested the C~ty of Danton to develop a cooperative after school program to
meet the needs of students at Calhoun, Stnckland, and McMath M~ddle Schools, and
WHEREAS, there ~s a need for after school programming for pre-teen and teen children
ex~st~ng m the C~ty of Denton, as expressed by parents, to promde these educational opportum-
t~es ~n a safe and superwsed enwronment, and
WHEREAS, the C~ty of Denton, through ~ts Parks and Recreation Department, has
worked cooperatively w~th DISD for many years to prowde for the needs of children ~n Denton,
and
WHEREAS, the C~ty's Parks and Recreation Department and DISD are able to prowde a
recreational educational program at Calhoun, Smckland, and McMath M~ddle Schools, whmh
~ncludes transportation ofpartmlpants on field trips, and
WHEREAS, the C~ty Manager adwsed the C~ty Council that such revenue and expendi-
ture was not ant~mpated prior to the adoption of the 1997-98 budget and could not have been ~n-
eluded ~n the original budget, and
WHEREAS, there was a movement of s~xth grade students ~nto the m~ddle school pro-
gram begmmng m August, 1998, and after school programs for th~s age group have been recog-
razed as a critical need on both a national and local level, and
WHEREAS, Section 8 08 of the Charter of the C~ty of Denton and Section 102 009 of the
Texas Local Govemmant Code provide that a governing body may authorize an emergency ex-
penditure as an amendment to the original budget only ~n a case of grave pubhc necessity to meet
an unusual and unforeseen condition that could not have been ~ncluded ~n the original budget
through the use of reasonably dd~gent thought and attention, and
WHEREAS, the C~ty Council finds that the failure to expend the funds dmcussed above
w~ll create a grave pubhc necessity and reqmres the 1997-98 budget to be amended ~n the
amount of twenty-one thousand five hundred rune dollars ($21,509 00), NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDA1NS
SECTION I. That the C~ty Councd hereby adopts the findings hsted above
SECTION II. That the 1997-98 Recreation Fund Revenue Budget of the City of Denton
is hereby amended m the amount of twenty-one thousand five hundred nine dollars ($21,509 00)
to be collected from the monthly fees of registered participants at Calhoun, Stnckland, and
McMath M~ddle Schools to provide a recreational educational program at Calhoun, Stnckland,
and McMath Middle Schools in cooperation with the Denton Independent School District, and
allocating such funds to the Children's Program Revenue account in the Recreation Fund
SECTION III That the 1997-98 Recreation Fund Budget of the City of Denton is hereby
further amended by expending sums from the unappropriated fund balance of the Recreation
fund to the following accounts

SECTION IV. That the City Secretary is directed to attach a copy of this ordinance to
the original budget and cause this amendment to be published once in the Denton Record-
Chrontcle
SECTION V That this ordinance shall become effective immediately upon its passage
and approval
