1998-153 NOTE Amended by Ordinance No. 99-169 %-98-019 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION TO OFFICE (CONDITIONED) (O[C]) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 4 996 ACRES OF LAND LOCATED AT 3311 TEASLEY LANE, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Jorry Yensan, on behalf of Gem ge Kolb, owner of the subject property, has apphed for a change in zoning for 4 996 acres of land from Agricultural (A) zoning dlsmct classification and use designation to Office (O) zoning district classification and use deslgnaUon, and WHEREAS, on April 30, 1998, a neighborhood meeting was held where six (6) residents attended along with the applicant and the owner were present, and WHEREAS, on May 13, 1998, the Planning mad Zomng Commmslon recommended approval of the requested change in zomng, and WHEREAS, the City Council finds that the change in zomng will be ~n comphance with the 1988 Denton Development Plan and the 1998 Denton Plan Policies, NOW, THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS Section I That the zomng district clasmficat~on and use demgnat~on of the 4 996 acre tract of land described m the legal description attached hereto and incorporated herein as Exhibit A, is changed from Agricultural (A) zomng &strict clasmficatlon and use demgnat~on to Office Conditioned (O[c]) zomng dmtnct classification and use designation, under the comprehensive zoning ordinance of the City of Denton, Texas, subject to the following conditions 1 That permitted land uses be restmcted to those descl~bed in the list attached hereto and incorporated here~n by reference as Exhibit B, and hmlt land uses permitted with a Specific Use Permit to those ordinarily permitted within a Office (O) zoning dlsmct with an approved Specific Use Penmt 2 That the total floor area for all bmldings on the 4 996 acres shall not exceed forty five thousand (45,000) square feet 3 That no loading docks shall be permitted 4 That the exterior walls of all bmldmgs shall be constructed of one hundred (100%) percent brick or masonry materials excluding dom s and windows 5 That only door sign on premises shall be permitted 6 Lighting on property shall be designed and mamtmned so as not to shine on or otherwise thsturb, surrounding residential property or to shine and project upward to prevent the d~ffumon into the mght sky z-g8 019 7 A "bufferyard" measuring twenty five (25) feet wide, and comprising four (4) canopy and eight (8) understory trees per each one hundred (100) linear feet, shall be installed along the east property line abutting residential lots 8 That the maximum budding height shall be one and one half (1 V~) stones high 9 No mthv~dual budding shall exceed seventy-five hundred (7,500) square feet 10 All bufldmgs must have pitched roofs and a slope of no less than thirty (30) percent 11 No parkang will be allowed in the front yard setback of any bmldlng along Teasley Lane Section II That the City's official zomng map ~s amended to show the change in zomng district classification ~ That any person violating any provision o f this ordinance shall, upon convlctaon, be fined a sum not exceethng $2,000 00 Each day that a provision of tins ordinance is violated shall constitute a separate and distanct offense $~etmn IV That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be pubhshed twice m the Denton Record-Chromcle, a daffy newspaper published in the City of Denton, Texas, wlttun ten (10) days of the date of its pas~a~ PASSED AND APPROVED thls the ~day of ~ ..2 , 1998 ATTEST.
