1998-167 ORDINANCE NO q f-- / ~? ~ AN ORDINANCE PARTIALLY VACATING A CERTAIN EASEMENT FOR THE CONSTRUCTION OF LOCAL ELECTRIC SERVICE LINES FROM LAKEWOOD ESTATES PARTNERSHIP TO THE CITY OF DENTON BY EASEMENT DATED MARCH 3, 1983, AND RECORDED IN VOLUME 1200, PAGE 803 OF THE DEED RECORDS OF DENTON COUNTY, TEXAS, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Denton has received a request for the partial abandonment of a certain easement for construction of local electric service lines, and WHEREAS, the Planning and Zomng Commmsion of the City of Denton, Texas reviewed the requested abandonment and recommended approval, and WHEREAS, the City Council of the C~ty of Denton, Texas has determined that the easement for the construction of local electric serwce lines being vacated is no longer needed for pubhc use, and WHEREAS, the Council d~rects that the process for determImng the fair market value of the said easement, as reqmred by Section 272 001 of the Texas Local Government Code, shall be followed m effectuating this abandonment, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS ~ That that certain portion of the above-referenced easement for the construction of local electric serwce hnes, dated March 3, 1983 from Lakewood Estates Partnership to the C~ty of Denton, Texas, recorded at Volume 1200, Page 803 of the Deed Records of Denton County, Texas, which portion being vacated m more particularly set forth and described m Exhibit "A" attached hereto and incorporated herewith by reference, ~s hereby vacated and abandoned as a pubhc easement to the extent descnbed m said exhibit Provided, however, that there ~s expressly reserved a pubhc utility easement evidenced by an "Easement" executed by Z~ff Investment Partners, a Partnership, to the C~ty of Denton, Texas on May 8, 1998, being recorded as Document No m the Real Property Records of Denton County, Texas, pertaimng to that one certain 2402 square foot tract or parcel of land
