AN ORDINANCE ABANDONING A DRAINAGE EASEMENT ON THE WEST 15 FEET OF
LOT 24, BLOCK C, OF HICKORY CREEK HEIGHTS ADDITION, AS RECORDED IN
CABINET N, SLIDE 101 OF THE DEED RECORDS OF DENTON COUNTY, TEXAS, AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, when the Hickory Creek Heights Add~uon was originally platted an error
was made indicating drainage facfl,t~es along west 15 feet of Lot 24, Block C when in fact the
facflmes were to be bu,lt along the west 15 feet of Lot 23, Block C and the error has been
corrected by the granting of a drainage easement as recorded in Clerk's File Number 98-
R0025111 of the Real Property Records of Denton County, Texas, and
WHEREAS, the Planning and Zomng Commission of the C~ty of Denton, Texas
reviewed the requested abandonment and recommended approval, and
WHEREAS, the Council of the City of Denton, Texas has determined that the dramage
easement described m Exhibit "A" ~s no longer needed for pubhc use, and
WHEREAS, that the process for determ~mng the fair market value of the easement
above, as apphcable, pursuant to Section 272 001 of the Texas Local Government Code relating
to the conveyance of easements to abutting property owners who own the underlying fee s~mple
shall be followed in effectuating th~s abandonment, NOW, THERFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I. That the drmnage easement ~dent~fied as the west 15 feet of Lot 24, Block
C, Hickory Creek Heights Addmon to the City of Denton, Texas, being recorded in Cabinet N,
Shde 101, of the Deed Records of Denton County, Texas, is permanently vacated and abandoned
as a pubhc easement, to the extent described ~n Exhibit "A" attached hereto and made a part
hereof for all purposes
SECTION II That by reason of such vacation the City of Denton's property interest ~n
the sa~d easement shall, by operation of law, revert to the owner or owners abutting the easement
hereto abandoned, and the C~ty of Denton releases any and all claims to the use of the vacated
property as a public easement
SECTION III That this ordinance shall become effective ~mmediately upon ~ts passage
and approval
