AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN INTERLOCAL
AGREEMENT WITH THE COUNTY OF TARRANT RELATING TO
PARTICIPATION IN VARIOUS COUNTY OF TARRANT CONTRACTS WHICH
PROVIDE FOR THE PURCHASE OF VARIOUS GOODS AND SERVICES, AND
DECLARING AN EFFECTIVE DATE (FILE # 2231 - INTERLOCAL AGREEMENT
WITH TARRANT COUNTY)
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the City Manager is authorized to execute a Interlocal
Agreement order between the City of Denton and County of Tarrant for the purchase of
various goods and serrates, under the terms and conditions, contained in the sa~d
Interlocal Agreement wluch is attached hereto and made a part hereof
SECTION II That the City Council hereby authorizes the expenditure of funds
in the manner and amount as specified m the purchase order
SECTION III That this ordinance shall become effective immediately upon its
passage and approval

INTERLOCAL AGREEMENT
BETWEEN COIJNTY OF TAREANT AND CITY OF DENTON, TEXAS
Th~s agreement ~s mede this 15th day of May, 1998, between the County of
Tarrant, Texas and the City of Denton, Texas
Pursuant to the authonty granted by the "Texas Interlocal Cooperation Act,"
Chapter 791 Texas Government Code prowd~ng for the cooperatmn between
local governmental bodies, the parties hereto, m cons~deratmn of the pram~ses
and mutual promises contained here~n, agree as follows
WHEREAS, the contract is made under the authority of Sections 791 001-
791 029 of the Texas Government Code, and,
WHEREAS, the parties, ~n performing governmental functions or ~n pay,ng
for the performance of governmental functtons hereunder shall make that
performance or those payments from current revenues legally available to that
party,
WHEREAS, the governing bodies of each party find that the subject qf
this contract is necessary for the benefit of the pubhc and that each party has the
legal authority to perform and to provide the governmental function or serv~ca
which ~s the subject matter of this contract, furthermore, the governing bodies
find that the performance of th~s contract ~s tn the common ~nterast of both
parties, and that the division of cost fairly compensates the performing party for
the services performed under th~s contract,
The C~ty of Denton, hereby makes, consbtutes and appoints Tarrant
County Its true and lawful purchasing agent for the purchase of various
commodities using Annual Contracts (B,ds) Tarrant County w~ll maintain a
listing of Annual Contracts which ara available for local ent~t~es use To utihze
one or more of these contracts, local entit,es must request authorization, ~n
wilting, to Tarrant County Upon recatpt of request, Tarrant County wtll send a
form letter to the approprlata vendor(s) for their approval and slgnatura Upon
receipt of authorizing letter from the vendor(s), Tarrant County w~ll forward a
copy of the letter and appropriate Annual Contract to the requesting entity The
City of Denton agrees that Tarrant County shall serve as the purchasing agent
for selected ~tams, and agrees that the b~ddmg shall be conducted by Tarrant
County according to ~ta usual b~dd~ng procedures and ~n accordance w~th
applicable State statutes
The City of Denton agrees that all specifications for selected ~tems shall
be as determined by Tarrant County
Ill.
The C~ty of Denton agrees to pay the suppher for all goods, equipment
and products pursuant to this agreement The successful bidder or b~dders shall
bill the C~ty of Denton directly for all ~tems purchased, and the C~ty of Denton
shall be reeponmble for vendor's comphance w~th all condibons of dehvery and
quahty of the purchased items

This agreement shall take effect upon executmn by both s~gnatones
