MULTI-FAMILY (MF-1) ZONING DISTRICT CLASSIFICATION TO PLANNED
DEVELOPMENT 166(PD-166) ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION FOR 4 873 ACRES OF LAND SURROUNDED BY 1-35 NORTH AND BONNIE
BRAE AND SCRIPTURE STREET AND WEST OAK STREET,APPROVING A DETAILED
PLAN AND A LANDSCAPE PLAN FOR DISTRICT PROVIDING FOR A PENALTY IN THE
MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR
AN EFFECTIVE DATE
WHEREAS, We~r and Associates, on behalf of Denton Commumty Hospital, has applied for
a change ~n zomng for 4 873 acres of land from Multi-Family 1 (MF-1) zoning d~stnct classlficatton
and use des~gnatuon to Planned development (PD) zomng dastnct classification and use des~gnatmn,
and
WHEREAS, on May 27, 1998, the Planning and Zoning Commlss~on recommended approval
of the requested change m zoning, and
WHEREAS, on May 27, 1998, the Planning and Zomng Commission recommended approval
of the detailed plan and landscape plan w~th the condlt~on that all trees and obstructions north and
south of the hehpad be removed from the landscape plan, and
WHEREAS, the C~y Council finds that the change m zomng will be ~n compliance w~th the
1988 Denton Development Plan and the 1998 Denton Plan Pohc~es, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the zomng d~stnct classification and use designation of the 4 873 acre tract
of land descnbed m the legal description attached hereto and incorporated hereto as Exhibit A, is
changed from Multi-Family 1 (MF-1) zoning dastnct classification and use designation to Planned
Development166(PD-166) zomng d~stnct classification and use des~gnatlon under the
comprehensive zomng ordinance of the City of Denton, Texas
~ That a detailed plan for the 4 873 acres contained in the new Planned
Development zomng district described by Exhibit A, ~s hereby approved and attached hereto and
incorporated harem as Exhlbat B, and a landscape plan for the 4 873 acres contained in the new
Planned Development zomng d~stnct ~s hereby approved and ~s attached hereto and ~ncorporated
herein as Exhibit C
~ That the C~ty's official zomng map is amended to show the change ~n zoning
d~stnct classification
SECTION IV That any person violating any provision of th~s ordanance shall, upon
conv~ct~on, be fined a sum not exceedmg $2,000 00 Each day that a prows~on ofth~s ordinance ~s
vtolated shall constttute a separate and dtstmct offense
~ That ttus ordinance shall become effective fourteen (14) days from the date
oftts passage, and the Ctty Secretary ts hereby dtrected to cause the captton ofthts ordinance to be
pubhshed twice m the Denton Record-Chromcle, a dmly newspaper pubhshed ~n the Ctty of Denton,
Texas, wtthm ten (10) days of the date oftts passage
