AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AUTHORIZING A JOINT PUBLIC HEARING WITH
THE PLANNING AND ZONING COMMISSION AND THE CITY COUNCIL TO BE HELD ON AUGUST 4,
1998 PURSUANT TO TEXAS LOCAL GOVERNMENT CODE §211 007 (b) AT THE CITY COUNCIL
CHAMBEP~ AT 7 O'CLOCK P M TO CONSIDER RECOMMENDATION AND ACTION UPON AN
ORDINANCE CREATING A CORRIDOR OVERLAY DISTRICT, PRESCRIBING NOTICE OF THE JOINT
MEETING pURSUANT TO TEXAS LOCAL GOVERNMENT CODE §211 007 (d) BY RUNNING
NEWSPAPER AD AND MAILING NOTICE TO OWNERS WITHIN THE PROPOSED DEFINED CORRIDOR
BOUNDAKIES, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS~ the Denton City Council has determined that corridors impact the visual image of the community, and
WHEREAS, the Denton City Council has requested that the City Planmng and Development Staff develop a
Corridor Overlay District Ordinance, and
WHEREAS, the Denton City Council desires to have alomt public heanng, pursuant to Texas Local Government
Code §211 007, with the Planning and Zoning Comrmsslon regarding the ordinance creating a Comdor Overlay
District on August 4, 1998 at the City Council Chambers at 7 o'clock p m, and
WHEREAS, the Denton City Council wishes to prescribe not,ce of the time and place of the Joint public hearing m a
manner that is efficient and eeononueal, and
WHEREAS, by a two-th~rds vote of the City Council, pursuant to Texas Local Government Code §211 007 (d),
prescribed that not,ce of the lomt public hearing shall be accomplished by pubhshmg a newspaper ad and by mailing
notice to each real property owner, as indicated by the most recently approved municipal tax roll, within the
proposed defined corridor boundaries of the proposed ordinance which is attached as Exhibit A, NOW
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS
~ That the Denton City Council and the City of Denton, Planning and Zoning Comnusslon
shall conduct a joint public hearing pursuant to Texas Local Government Code §211 007 on August 4, 1998 at the
City Council Chambers at 7 o'clock p m to consider, make recommendation, and take any appropriate action
concerning a proposed ordinance to create a Corndor Overlay D~stnct
~ That the notace of the tame and place for the joint public hearing on August 4, 1998 shall
be given by placing an ad m the Denton Record-Chromcle and by mailing mdlwdual notice to each real property
owner, as indicated by the most recently approved munmipal tax roll, within the proposed defined corridor
boundaries of the proposed ordinance, which is attached and incorporated hereto as Exhibit A That the notmes shall
be sent or published at least ten days before the proposed joint public hearing
~ That this urdmance shall become effectave immediately upon its passage and approval

ARTICLE XI. PROPOSED CORRIDOR OVERLAY DISTRICT
Sec. 35-413. Classifications.
1) Gateways' The Gateway des~gnation is reserved for the roadways with the highest
volume of traffic and provides hmited direct access Roads designated as Gateways
include 1-35 N, 1-35 W, 1-35 E, Loop 288, U.S Highway 380 from Primrose Street
west to the city limits and U.S. Highway 380 from Ruddell Street east to the city
limits. Along Gateways, maximum efforts will be taken to preserve natural features
~nclud~ng trees, native vegetation, and v~ews Regulations shall be apphed to property
wittnn a 500 foot wide strip on each side of the roadway measured from the centerhne of
the roadway, and the regulations shall apply to the entire property whether all or part of
the property Is located within the total 1,000-foot wide strip
2) Entranceways' Entranceways are classified as primary or secondary arterials and
may have curb and gutter or barrow ditch or swales along the right-of-way
Entranceways shall ~nclude US Hwy 77 from 1-35N to Windsor Dr, Tcasley Lane (FM
2181), Fort Worth Drive (US Highway 377) from 1-35 E south to the city hmits, Locust
Street (FM 2164) from Loop 288 north to the c~ty bmtts, McK~nney Street (FM 426)
from Loop 288 east to the city limits, and Sherman Drive (FM 428) from Loop 288 north
to the city limits Regulations shall be apphed to all property located w~th~n 250 feet
from the centerhno of the roadway and the regulations shall apply to the entire property
whether all or part of the property Is located within the 500-foot wide str~p
3) City limits: The regulations shall apply to property along the designated roadway that
is within the city hm~ts As annexation occurs along the designated roadways the
regulations shall apply to the area annexed
