1998-200 ORDINANCE NO q g-??OO AN ORDINANCE PROVIDING FOR THE EXPENDITURE OF FUNDS FOR EMERGENCY PURCHASES OF MATERIALS EQUIPMENT, SUPPLIES OR SERVICES IN ACCORDANCE WITH THE PROVISIONS OF STATE LAW EXEMPTING SUCH PURCHASES FROM REQUIREMENTS OF COMPETITIVE BIDDING, AND PROVIDING FOR AN EFFECTIVE DATE (PURCHASE ORDER # 86380 TO BRANDON & CLARK, INC FOR ONE 800 HP ELECTRIC MOTOR IN THE AMOUNT OF $29,600 00) WHEREAS, state law and ordinance require that certain contracts requmng an expenchtum or payment by the City m an amount exceeding $15,000 be by competitive bids, except in the case of public calamity where it becomes necessary to act at once to appropriate money to relieve the necessity of the mtlzens of the city, or in case of unforoseen damage to public property, machinery or equipment, and, WHEREAS, the City Manager has recommended to the City Council that it is necessary to purchase goods or services due to the following emergency conditions outlined in the memorandum attached hereto as Exhibit "A", incorporated herein by reference, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the City Council hereby determines that there is a public calamity that makes it necessary to act at once to appropriate money to relieve the necessity of the citizens, or to preserve the property of the city, or to protect the public health of the citizens of the city, or to provide for unforeseen damage to public property, machinery or equipment, and by mason thereof, the following emergency purchases of materials, equipment, supplies or services, as described in the "Purchase Orders" attached hereto, are hereby approved PURCHASE ORDER NUMBER VENDOR AMOUNT 86380 Brandon & Clark, Inc $29,600 00 ~ That because of such emergency, the Clty Manager or designated employee is hereby authorized to purchase the materials, equipment, supplies or services as described an the attached Purchase Orders and to make payment therefore in the amounts therein stated, such emergency purchases being in accordance with the provmons of state law exempting such purchases by the City from the requirements of competitive bids SECTION III That this ordinance shall become effective lmmedmtely upon ~ts passage and approval ' PASSED AND APPROVED th~s the ~a'~/~ dayof ~ ,1998 ATTEST JENNiFER WALTERS~, CITY SECRETARY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY 86380 EMERGENCY PURCHASE ORDER ORDINANCE EXHIBIT "A" PURCHASE ORDER # 86380 - BRANDON & CLARK, INC On June 25, 1998, at approximately 6 30 p m, the Lake Pump Umt 1 raw water pump failed The pump shaft broke causing major damage to the 800 horsepower electric motor powenng the pump The motor was damaged beyond repmr A recondmoned pump motor was located by Brandon & Clark and has been ordered Pump repmrs were ordered and completed by a separate contractor A new motor would cost somewhere between $30,000 and $41,000 00, and have a delivery t~me ofapprox~mately 10-22 weeks ~I he pump repairs have been completed and the motor installation should have been completed on July 17, 1998 The Public Utility Board has been briefed on the pump and motor failure and the progress o f the repmr efforts This emergency purchase will be funded from 1997-98 budget funds for mmntenance of plant and equipment, account # 620-081-0460-8339 Th~s pumhase order ~s for the emergency purchase of an 800 horsepower electric motor to replace the Lake Pump Umt 1 motor Th~s motor ~s recond~tioned and carries a 1 ~year warranty The price of $29,600 00 includes freight to the C~ty of Denton jobs~te Due to the crttlcal nature of a continuous dependable supply of raw water from Lewlsvllle Lake to the Water Treatment Plant, tins acqmmt~on has been declared an emergency and Is exempt from the b~d process (Texas Local Government Code Chapter 252)
