AN ORDINANCE OF THE CITY OF DENTON, TEXAS ADOPTING A LOGO TO BE USED
AS THE OFFICIAL LOGO OF THE ELECTRIC UTILITY OF THE CITY OF DENTON,
TEXAS, PROHIBITING THE USE OF SUCH LOGO BY ANY PERSON, FIRM,
CORPORATION, OR ORGANIZATION, OTHER THAN THE CITY OF DENTON
WITHOUT WRITTEN APPROVAL OF THE CITY MANAGER, PROVIDING FOR A
PENALTY NOT TO EXCEED FIVE HUNDRED DOLLARS FOR EACH DAY OF
VIOLATION, PROVIDING FOR A REPEALER, PROVIDING FOR A SEVERABILITY
CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, on April 19, 1994, the City Council enacted Ordinance No 94-074 which
adopted an official Logo to be used on all officml C~ty of Denton materials, eqmpment, and
supphes, and thereafter, on January 9, 1996 the C~ty Council enacted Ordinance No 96-011
amending Ordinance No 94-074 m several respects, and
WHEREAS, heretofore the City of Denton has not adopted a separate officml Logo for
~ts mumc~pal electric utility, and at th~s t~me desires to do so, which Logo shall be used on all
official Denton Mumc~pal Electric materials, eqmpment and supphes, and
WHEREAS, m connection w~th the adoption of th~s Logo, the C~ty's mumc~pal electric
utd~ty has conducted a poll of C~ty of Denton mumc~pal electric ut~hty ratepayers to determine
which of two proposed Logos presented to them, was the most favored Logo by a majority of the
C~ty of Denton mummpal electric uhhty ratepayers completing ballots and voting therefor, and,
after the close of the poll, all votes were tabulated, and ~t has been determined that Logo No
Two recetved the majority of sa~d votes The C~ty Council has therefore determined that ~t
should adopt Logo Number Two, as attached hereto as Exhibit "A", as the offimal Logo of
Denton Mtmlmpal Electric, and
WHEREAS, the foregoing actions of the C~ty Councd are conmstent w~th and permitted
by the prows~ons of Section 1 05 of the City Charter, and
WHEREAS, apphcat~on shall be made to copyright the Logo as the property of the C~ty
of Denton, and
WHEREAS, as the officml Logo of Denton Mumc~pal Electric, the C~ty Council is of the
opinion that the same should not be used by any other person, firm, corporation, or organization
for any purpose w~thout the written approval of the C~ty Manager, NOW, THEREFOR,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the Logo as set forth in the attached Exhibit "A" ~s hereby approved
and adopted as the officml Logo of Denton Mumc~pal Electric Th~s officml Logo shall be
reflected and utilized on all Denton Mumctpal Electric eqmpment, supphes, and materials
ordered or purchased after the effecttve date of this ordinance
SECTION II That no person, firm, corporation, or organization, other than the City of
Denton shall adopt, use, dasplay, incorporate, or appropriate the official Logo of Denton
Municipal Electric as any part of any material, equipment, or other matter of such person, finn,
corporation, or organization w~thout written application to and written approval of the City
Manager
SECTION III That any person, firm, corporation or organazatlon violating any prowsaon
of this or&nanee shall, upon eonwctlon, be fined a sam not exceeding Two Hundred Dollars
($200 00) Each day that a provaslon of this ordanance is violated, shall constatute a separate and
&stmct offense
SECTION IV That all ordinances or parts of ordinances in force when the provisions of
this ordinance became effective, aneludlng wathout hmltaUon, Ordinance No 94-074, which are
inconsistent or in conflict wath the terms or provasaons contmned an this ordanance, are hereby
repealed to the extent of any such confl~et
SECTION V That ff any section, subsection, paragraph, sentence, clause, phrase or
word con~mned an thas ordinance, or application thereof to any person or circumstances is held
anvahd by any court of competent junsdactaon, such holding shall not affect the vahdaty of the
remmnlng portaons of this ordinance, and the City Council of the City of Denton, Texas, hereby
declares it would have enacted such remaining portions despite any such lnvahdlty
SECTION VI That th~s ordinance shall become effective fourteen (14) days from the
date of ats passage, and the City Secretary is hereby directed to cause the caption of this
ordinance to be pubhshed twice m the Denton Record-Chromcle, the official newspaper of the
Caty of Denton, Texas, w~thm ten (10) days of the date of its passage
