IMPROVEMENTS PLAN AND WATER AND WASTEWATER IMPACT FEES IN ACCOR-
DANCE WITH CHAPTER 395 OF THE LOCAL GOVERNMENT CODE, REQUIRING THE
CITY SECRETARY TO POST NOTICE OF THE PUBLIC HEARING AND TO PROVIDE
ADDITIONAL NOTICE OF THE PUBLIC HEARING AS SET FORTH IN THE BODY OF
THIS ORDINANCE, AND PROVIDING AN EFFECTIVE DATE
WHEREAS, on March 17, 1998, the Caty Council passed Ordinance No 98-081 ap-
pmntang the Planning and Zomng Commmmon members and one addatlonal ad hoc member from
the extratemtonal jurisdiction of the City as the Denton Capatal Improvements Advmory Com-
mattee ("Commxttee"), m accordance wath Tex Loc Gov't Code §395 058 to study and make
recommendations concermng the lmposmon of impact fees, and
WHEREAS, after the Committee made its recommendations to the Clty Council, the Caty
Council called a pubhc heanng by passage of Ordinance No 98-111 on April 21, 1998, held a
pubhc heanng to consader land use assumptaons related to the possable adoptmn of ampact fees to
recover costs related to water and wastewater treatment faclhtles on June 2, 1998, and passed an
ordinance adoptang the land use assumptaons on June 16, 1998, and
WHEREAS, the Committee shall file Its written recommendations on the Capital Im-
provements Plan and impact fees before the fifth business day before the date of the pubhc
heanng on the Plan and ampact fees m accordance with Te-x Loc Gov't Code §395 050, and
WHEREAS, the Caty Council deems at an the public interest to set a pubhc heanng on the
adoption of the Cepatal Improvements Plan and the adoptaon of impact fees, NOW, THERE-
FORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the Caty Council hereby calls a pubhc heanng to be held an the Caty
Council Chambers in the Munmlpal Bmldmg at 215 East McKluney Street, Denton, Texas at
7 00 p m on September 1, 1998 to conmder the adoption of the Capital Improvements Plan and
the ampomt~on of the impact fees within a designated service area that includes an area both
wathm tile corporate mty hmRs of Denton and portions of Its extraterritorial junsdmtaon as more
fully shown on the attached notme of public heanng relatang to the posmble adoptaon of the
Capital Improvements Plan and ampact fees to recover costs related to water and wastewater
treatment famhtles
~ That the City Secretary and the Director of Water Utthtaes are hereby di-
rected to pubhsh notice of the hearxng once a week for three consecutive weeks, the first notice
to appear before the 30th day, but on or after 60th day before the above date set for the heanng, in
the Denton Record-Chromcle, smd notme to be substantially in accordance with the notme of
pubhc l~eanng wluch m attached to and made a part of thas ordanance for all purposes and in
comphance wxth Tex Loc Gov't Code §395 049 On or before the 30th day before the date of
the heanng on adoption of ~mpact fees and the Capital Improvements Plan, the City Secretary
and the Director of Water Utilities are hereby d~rected to send a notice of the heanng by cerhfied
mall to any person who has g~ven written not,ce by certified or regtstered marl to the City Sec-
retary or other demgnated officml of the Oty requesting not~ce of the hearing w~tban two years
precedang the date of the adoption of the ordinance setting the pubhc heanng The notice of
pubhc hearing may not be m the part of the paper m which legal notices and clasmfied ads ap-
pear, and may not be smaller than one-quarter page of a standard-raze or tabloid-raze newspaper,
and the headhne on the not,ce must be m 18-point or larger type

available to the pubhc the Oty's Capital Improvements Plan in comphance w~th Tex Loc Gov't

Street, Denton, Texas
