AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM THE AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION TO THE COMMERCIAL CONDITIONED (C[c]) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION FOR 11 484 ACRES OF LAND LOCATED
NORTH OF HIGHWAY 77, EAST OF ITS INTERSECTION WITH 1-35, PROVIDING FOR
A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF,
AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Rancho V~sta Development Company m~t~ated a change ~n zoning for
11 484 acres of land from the Agrmultural (A) zomng d~stnct classfficat~on and use designation
to the Commercml Conditioned (C[c]) zomng d~stnct classification and use designation, and
WHEREAS, on May 27, 1998, the Planmng and Zomng Comm~sston recommended
approval of a change from the Agricultural (A) zomng d~stnct classification and use designation
to the Commarc~al Condmoned (C[c]) zomng d~stnct classfficat~on and use designation, and
WHEREAS, the C~ty Counctl finds that the change in zoning wdl be ~n comphance w~th
the Denton Development Plan, NOW THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the zomn8 d~stnct classfficat~on and use designation of the 11 484
acres of land described ~n Exhibits A and B, attached hereto and ~ncorporated by reference
hereto, ~s changed from the Agricultural (A) zoning d~stnct classification and use designation to
the Commercial Conditioned (C[c]) zomng d~stnct classification and use designation under the
comprehensive zoning ordinance of the C~ty of Denton, Texas, subject to the following
conditions
1 L~ghtmg on the property shall be designed and maintained so as not to shine on, or
otherwise d~sturb surrounding residential property or to sh~ne and project upward to
prevent the d~ffus~on ~nto the mght sky
SECTION II That the C~ty's officml zoning map ~s amended to show the change ~n
zomng district classfficatton
~ That any person wolatmg any prov~s~on of th~s ordinance shall, upon
conv~ctton, be fined a sum not exceeding $2,000 00 Each day that a prov~s~on ofth~s ordinance
~s v~olated shall constitute a separate and d~stmct offense
SECTION IV That th~s ordinance shall become effective fourteen (14) days from the
date of ~ts passage, and the C~ty Secretary ~s hereby d~rected to cause the caption of th~s
ordinance to be pubhshed twice ~n the Denton Record- Chromcle, a daffy newspaper pubhshed ~n
the C~ty of Denton, Texas, w~tlun ten (10) days of the date of~ts passage
