1998-235AN ORDINANCE AUTHORIZING THE CITY MANAGER TO FILE AN APPLICATION
WITH AND TO EXECUTE A GRANT AND SUBSEQUENT AMENDMENTS WITH THE U S
DEPARTMENT OF TRANSPORTATION FEDERAL TRANSIT ADMINISTRATION FOR
PROJECT NO TX-90-X446, A GRANT FOR FUNDING PUBLIC TRANSPORTATION AS
AUTHORIZED BY 49 U S C §5307, AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the Secretary of Transportation is authorized to award grants for a mass
transportation program of projects and budget, and
WHEREAS, the City has been advised by the U S Department of Transportation Federal
Transit Admlmstratton that Congress has adopted a maximum of $430,000 for an urbamzed grant
anthonzed by 49 U S C §5307 for the City of Denton and has requested the City to apply for the
Grant Agreement, and
WHEREAS, the Grant Agreement, winch incorporates the Federal Transit Admlmstratlon's
Master Agreement, if approved, will ~mpose certmn obhgatmns upon the applicant, such as the City
of Denton, including the provision by it of the local share of the project costs an the program, and
WHEREAS, the U S Department of Transportation requires, in accordance with the
provlsxon$ of Titles VI and VII of the Owl Raghts Act of 1964, as amended, that the applicant give
an assurance that it will comply w~th Title VI of the Ovfl Raghts Act of 1964 and the Department
of Transportation reqmrements thereunder, and
WHEREAS, it is the goal of the applicant that d~sadvantaged bus~ness enterprises be
utthzed to the fullest extent possible in connection with the project, and that defimte procedures
shall be established and adnnmstered to ensure that d~sadvantaged businesses shall have maximum
construction contracts, supplies, equipment, contracts, or consultant and other services, NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the City Manager is anthonzed to file an appheat~on with and to execute
a grant and subsequent amendments on behalf of the Oty of Denton, Texas, with the U S
Department of Transportation, relating to ProJect No TX-90-X446 to md in the financing of
operating assistance for pubhc transportation pursuant to 49 U S C §5307 The City Manager,
however, is not anthonzed to amend the grant by more than the amount authorized by Chapter 10
of the Code of Ordinances of the City of Denton, Texas
S~CTION II That the City Manager is anthonzed to execute and file an assurance or any
other document reqmred by the U S Department of Transportation effectuating the purpose of
Titles VI and VII of the Civil Raghts Act of 1964
SECTION IR That the City Manager or bas designee is anthonzed to furnish such
additional information, assurances, or eertfficat~ons as the U S Department of Transportation may
reqmre in connection with the program of projects
SECTION IV That the City Manager is anthonzed to set forth and execute disadvantaged
bus~ness anterpnse pohcles in conneetton with the program of projects and budget agreement
mqmred by the Grant
SECTION V That the C~ty Manager is authorized to execute a grant agreement, in
substantmlly the form of the attached Grant Agreement, wbach is incorporated as a part of tbas
ordinance, along with any other agreement documents necessary to secure the grant on behalf of the
City of Denton, Texas with the U S Department of Transportation for md m the financmg of the
capital, and operating assistance program of projects and budget, and to expend the necessary funds
as may be required by the cond~tton of the grant
SECTION VI That tbas ordinance shall become effective ~mmedmtely upon ~ts passage
and approval
