AN ORDINANCE REPEALING ORDINANCE NUMBER 98-180 APPROVED BY COUNCIL
YU-LY 14, 1998 AND PROVIDING FOR THE EXPENDITURE OF FUNDS FOR PURCHASES
OF MATERIALS OR EQUIPMENT TO UPGRADE THE ELECTRIC DISTRIBUTION
METERING CAPABILITIES WHICH ARE AVAILABLE FROM ONLY ONE SOURCE IN
ACCORDANCE WITH THE PROVISIONS OF STATE LAW EXEMPTiNG SUCH PURCHASES
FROM REQUIREMENTS OF COMPETITIVE BIDS, AND PROVIDiNG AN EFFECTIVE
DATE (PURCHASE ORDER # 86080 - CUMMiNS UTILITY SUPPLY iN THE AMOUNT OF
$35,840 00)
WHEREAS, Section 252 022 of the Local Government Code provides that procurement of
~tems that are only avmlable from one source, ~ncludmg ~tems that are only avmlable from one
source because of patents, copyrights, secret processes or natural monopohes, films, manuscripts or
books, electricity, gas, water and other utfltty purchases, captive replacement parts or components
for eqmpment, and hbrary materials for a pubhc hbrary that are avmlable only from the persons
holding exclusive chstnbuUon rights to the materials, need not be submitted to compeUUve b~ds, and
WHEREAS, the C~ty Council wishes to procure one or more of the ~tems menUoned in the above
paragraph, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the following purchases of materials, eqmpment or supphes, as described ~n
the "Purchase Orders" attached hereto, are hereby approved

SECTION II That the acceptance and approval of the above ~tems shall not consutute a contract
between the C~ty and the person submitting the quotation for such ~tems until such person shall
comply wath all requrrements specffied by the Purchasing Department
SECTION III That the C~ty Manager ~s hereby authorized to execute any contracts relating to
the ~tems ,specffied ~n Section I and the expenrhture of funds pursuant to smd contracts ~s hereby
authorized
SECTION IV That this ordinance shall become effective ~mmed~ately upon its passage and
approval
