1998-255 NOTE Amended by Ordinance No. 99-242 Z 08 052 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION TO OFFICE CONDITIONED (O[C]) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 1 831 ACRES OF LAND LOCATED AT 3517 TEASLEY LANE, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Jerry Yensan, on behalf of Joey and Sheme Hlgglns, has applied for a change in zoning for 1 831 acres of land from Agricultural (A) zoning district classification and use designation to Conditioned Office (O[e]) zoning district classification and use designation, and WHEREAS, on July 29, 1998, a neighborhood meeting was held where at nine (9) residents attended along with the applicant and the owners were present, and WHEREAS, on August 12, 1998, the Planning and Zoning Commission recommended approval of the requested change in zomng, and WHEREAS, the City Council finds that the change in zomng will be in compliance w~th the 1988 Denton Development Plan and the 1998 Denton Plan Policies, NOW, THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the zoning district classification and use designation of the 1 831 acre tract and described in the legal description attached hereto and incorporated herein as Exhibit A, is changed from Agricultural (A) zomng district clasmficat~on and use designation to Office Conditioned (O[c]) zomng district classification and use designation under the comprehensive zoning ordinance of the City of Denton, Texas, subject to the following conditions 1 That permitted land uses be restr, cted to those described in the list attached hereto and incorporated hereto by reference as Exhibit B, and allow land uses permitted with a Specific Use Permit m an Office (O) zoning d~stnct 2 That the total floor area for all buildings on the 1 831 acres shall not exceed sixteen thousand and five hundred (16,500) square feet 3 That no loading docks shall be permitted 4 That the exterior walls of all braidings shall be constructed of one hundred (100%) percent brick or masonry materials excluding doors and windows 5 That only door sign on-premmes shall be permitted 6 Lighting on the property shall be designed and mmntmned so as not to slune on or othemvme disturb, surrounding residential property or to shine and project upward to prevent the diffusion ~nto the mght sky PAGE 1 Z 98 032 7 A "bufferyard" measunng twenty-five (25) feet w~de, and comprising four (4) canopy and eight (8) understory trees per each one hundred (100) hnear feet, shall be Installed along the east property line abutting resldentml lots 8 That the maximum bmlding height shall be one and a half (1 ½) stones high 9 No individual bmlchng shall exceed seventy-five hundred (7,500) square feet l0 All buildings must have pitched roofs and a slope of no less than thirty (30) percent 11 No parking will be allowed in the front yard setback of any building along Teasley Lane SECTION II That the City's official zomng map is amended to show the change in zomng district classification SECTION III That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a promslon of thru ordinance is violated shall constitute a separate and distinct offense SECTION IV That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be pubhshed twice m the Denton Record-Chromcle, a daffy newspaper published m the City of Denton, Texas, w~thln ten (10) days of the date of its
