Amended by Ordinance No. 99-298 ORDINANCE NO AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING THE SCHEDULE OF MISCELLANEOUS FEES, DEPOSITS, BILLINGS AND PROCEDURES FOR PROVIDING ADMINISTRATIVE SERVICES TO CITY CUSTOMERS AND TAXPAYERS CONTAINED IN ORDINANCE NO 93-164, AMENDING THE DELINQUENT SERVICE FEE FOR RECONNECTION OF SERVICE AFTER HOURS, AMENDING THE CREDIT CARD SERVICE FEE, AMENDING THE CREDIT CARD SERVICE FEE PROVISIONS CONTAINED IN ORDINANCE NO 95-096, PROVIDING FOR A REPEALER, PROVIDING FOR A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the schedule of fees and charges for general utility services as generally provided for in Chapter 26 of the Code of Ordinances, and for services to other City of hours METER CONNECTION FEE APPLICATION Apphcable when a customer requests service at an address which has ex~st~ng or prevtous servme, w~th an extsttng account number and h~story FEE First Servme Requested $10 00 F~rst Servme Requested, after $30 00 busaness hours DELINQUENT SERVICE FEE APPLICATION Apphcable when a customer's account ts processed for &sconnectton due to nonpayment FEE Dehnquent Servme Fee $20 00 Dehnquent Service Fee $50 00 and reconnect~on after business hours Page 2 METER READING AND TEST FEES (Effective 10/01/98) Meter Reading APPLICATION Applicable to any customer who requests a reading of a city meter due to a contested billing more than twice in the previous 12 months and no error is found FEE Per Additional Reading $20 00 Meter Testing APPLICATION Applicable to any customer who requests the testing of a city meter previously tested wtth~n the past four years and the meter is found to be within accuracy standards FEE Per Test $25 00/KWH Electric Meter $35 00/KW & KWH Electric Meter ACCURACY STANDARDS A meter is defined as within accuracy standards when found to be in error plus or m~nus two percent (2%) or less Page 3 MISCELLANEOUS FEES, CHARGES, AND DEPOSITS (Effective 10/01/98) INSUFFICIENT FUND CHECK HANDLING CHARGE APPLICATION Applicable when a customer's or taxpayer's check for payment of fees, fines, court costs, taxes, uuhties, or other charges has been dishonored by the maker's bank and returned to the City of Denton FEE Por Check $15 00 SERVICE DEPOSITS APPLICATION Apphcable when a customer requests utlhty service for the first t~me in the Denton service area and does not have 12 months of good credit standing w~th Denton or another utility system for the type of service requested, or does not have a co-s~gner with 12 months of good credit standing with Denton or another electric utility system FEE Residential Customer $150 00 or an amount equal to 1/6 of the last 12 months of bllhng at the service location If utility servme is disconnected for non- payment, then the customer will be required to pay a deposit sum equal to 1/6 of the last 12 months of billing Commercml Customer $300 00 or an amount equal to 1/6 of the last 12 months of bflhng at the service location, whichever is greater Deposits will earn tnterest for the customer The rate of interest will be adjusted semi-annually to equal the interest rate of a one year Umted States Treasury Note on October 1 and April 1 of each year If refund of deposit is made within thirty (30) days of receipt of deposit, no interest payment will be made If the C~ty retains the deposit more than thirty (30) days, payment of interest shall be made retroactive to the date the deposit was paid A Payment of the interest to the customer shall be made at the t~me the deposit is returned or credited to the customer's account B The deposit shall cease to earn interest on the date ~t is returned or credited to the customer's account Page 4 CONTRACT RETAINAGE Contract retmnage will earn interest for the contractor as provided by TEX REV CIV STAT ANN Article 6252, Sec 5b (Vernon Supp 1992) The rate o£ interest will be adjusted semi- annually to equal the interest rate of a one year United States Treasury Note on October 1 and April 1 o£¢ach year Payment of the ~nterest shall be made at the ume the retalnage is prod to the contractor CREDIT CARD SERVICE FEE APPLICATION Applicable when payment for fees, fines, court costs, taxes, uulmes or other charges are made w~th a "Discover" credit card RATE/SERVICE CHARGE Payment Amount Service Charge $ ordinance became effective which are ~ncons~stent, or ~n conflict w~th the terms or prows~ons contmned ~n th~s ordinance are hereby repealed to the extent of any such confltct SECTION III That ff any section, subsection, paragraph, sentence, clause, phrase or word ~n this ordinance, or apphcat~on thereof to any person or c~rcumstances is held ~nvalld by any court of competent jurisdiction, such holding shall not affect the vahdlty of the rema~mng portions of th~s ordinance, and the C~ty Council of the C~ty of Denton, Texas, hereby declares ~t would have enacted such remmmng pomons despite any such ~nvalld~ty SECTION IV That th~s ordinance shall become effective, charged, and apphed to all servmes occumng on or after October 1, 1998, and a copy of smd fees and charges shall be mmmalned
