1998-268 NOTE Amended by Ordinance No 99-371 O INANCENO AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING AND ADOPTING THE SCHEDULE OF FEES AS AUTHORIZED BY CHAPTER 34 AND CHAPTER 35 OF THE CODE OF ORDINANCES FOR THE CITY OF DENTON, TEXAS, FOR FILING APPLICATIONS FOR REVIEW, APPROVAL, GRANT OR ISSUANCE OF PLATS, PLANS, LICENSES, CERTIFICATES, VARIANCES OR DESIGNATIONS REQUIRED BY THE SUBDIVISION RULES AND REGULATIONS AND ZONING REGULATIONS OF THE CODE OF ORDINANCES, AMENDING SECTION 34-10 OF CHAPTER 34 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON AND CHAPTER 35 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON BY ADDING SECTION 35-56, PROVIDING FOR THE EXEMPTION OF THE CITY OF DENTON AND THE POLITICAL SUBDIVISIONS AND AGENCIES OF THE STATE OF TEXAS AND THE UNITED STATES OF AMERICA FROM THE FEES OF CHAPTER 34 AND CHAPTER 35, CODE OF ORDINANCES, CITY OF DENTON, TEXAS, PROVIDING FOR REPEAL OF ALL ORDINANCES 1N CONFLICT HEREWITH, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION, AND PROVIDING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the Development Review Fee Schedule set forth ~n Exhibit "A", attached hereto and made a part hereof for all purposes, ~s hereby adopted and anthonzed to be ~mposed for the fihng of apphcatlons, review, approval, grant or issuance of plats, plans, permits, hcenses, certificates, variances or designations required by the Subd, wmon Rules and Regulations and Zoning Regulations set forth and authorized m Chapters 34 and 35 respectively of the Code of Ordinances of the C~ty of Denton SECTIQN II, That Chapter 34, Section 34-10 of the Code of Ordinances of the City of Denton ~s hereby amended so that smd section shall hereafter be and read as follows See 34-10 Fees. The C~ty Cotmml may, by ordinance, ~mpose one or more fees m an amount it determines necessary to recover the cost of adm~mstenng the provlmons of thru chapter Notwithstanding any other provision of this chapter, the payment of any fees under thru chapter shall not be apphcable to the C~ty of Denton and any pohtlcal subdivisions or agencies of the State of Texas and the Umted States of America SECTION III That Chapter 35, Code of Ordinances of the C~ty of Denton ~s hereby amended by the addition of the following Section 35-56 and shall hereafter be read as follows See 35-56. Exemptions from fees. Notw~thstanchng any other provisions of thru chapter, the payment of any fees under th~s chapter shall not be appl,cable to the City of Denton and any poht~cal subdlwmons or agencies of the State of Texas and the United States of America SECTION IV That this ordinance shall repeal every prior ordinance m conflict herewith, but only insofar as the portion of such prior ord, nance shall be m conflict, and as to all other sections of the ordinance not ~n d~rect conflmt herewith, th~s ordinance shall be and ~s hereby made cumulative except as to such prior ordinances or portions thereof as are expressly repealed hereby SECTION V That ff any prows,on of th~s ordinance or appbcat~on thereof to any person or c~rcmnstance is held ~nvahd by any court, such holding shall not affect the vahd~ty of the remmmng portions of th~s ordinance, and the C~ty Cotmcd of the C~ty of Denton, Texas, hereby declares that it would have enacted the remmnmg portions despite any such vahd~ty SECTION VI That th~s ord, nance shall become effective, after ~ts passage and approval, on October 1, 1998, and the C~ty Secretary ~s hereby d~rect to cause the caption of th~s ordinance to be pubhshed twine ~n the Denton Record Chromcle, a dmly newspaper published ~n the C~ty of Denton, Texas w~th~n ten (10) days of the date or,ts passage PASSED AND APPROVED onthlS the ~ dayof ~~:~, 1998 JACK I~ER, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY AS ,O ,O= Tf & HERB PROUTY, CITY ATTORNEY EXHIBIT A.
