REPEAL OF ORDINANCE 83-129 ESTABLISHING CERTAIN FEES, PROVIDING FOR
THE REPEAL OF ORDINANCE 90-161 PROVIDING FOR DEMOLITION FEES,
PROVIDING FOR THE ADOPTION OF A FEB SCHEDULE FOR THE FILING OF
APPLICATIONS, REVIEW, APPROVAL, GRANT OR ISSUANCE OF PERMITS,
INSPECTIONS, LICENSES, CERTIFICATES, VARIANCES OR DESIGNATIONS
REQUIRED BY THE "BUILDINGS AND BUILDING REGULATIONS" AND "SIGNS AND
ADVERTISING DEVICES", SET FORTH IN CHAPTERS 28 AND 33 OF THE CODE OF
ORDINANCES OF THE CITY OF DENTON, AMENDING CHAPTER 28, CODE OF
ORDINANCES, CITY OF DENTON, TEXAS BY ADDING SECTION 28-32 PROVIDING
FOR AN EXEMPTION FROM FEES FOR THE CITY OF DENTON AND POLITICAL
SUBDIVISIONS AND AGENCIES OF THE STATE OF TEXAS AND THE UNITED
STATES OF AMERICA, PROVIDING FOR THE REPEAL OF ALL ORDINANCES THAT
CONFLICT HEREWITH, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A
SAVINGS CLAUSE, PROVIDING FOR PUBLICATION, AND PROVIDING AN
EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That Chapter 28, Section 28-28(3) of the Code of Ordinances of the C~ty of
Denton is hereby amended so that smd section shall hereafter be and read as follows
(3) Sectton 107 2, Permzt Fees Section 107 2 is amended to read as follows
The applicant shall submit the applicable permit fee as set by City Council by ordinance
and the fee schedule shall be avmlable for pubhc inspection at the offices of the Building Offic,al
and the City Secretary
SECTION II That Chapter 28, Section 28-28(4) of the Code of Ordinances of the City
of Denton is hereby amended so that sand section shall hereafter be and read as follows
(4) Section 107 3, Plan Review fees Section 107 3 Is amended to read as follows
The applicant shall submit the applicable plan review fee as set by City Council by
ordinance, and the fee schedule shall be available for public inspection at the offices of the
Building Official and the City Secretary
SECTION III That Chapter 28, Section 28-28(7) of the Code of Ordinances of the City
of Denton is hereby amended so that smd section shall hereafter be and read as follows
(7) Sectton 108 8, Retnspecttons The fourth paragraph of section 108 8 is amended to
read as follows
To obtmn a remspectlon, the applicant shall pay the applicable remspectlon fee as set by
City Council by ordinance and then request an inspection in the manner prescribed by the
building official
The fee schedule shall be avmlable for public inspection at the offices of the Building Official
and the City Secretary
SECTION W. That Chapter 28, Sections 28-28(9)a and 28-28(9)b (1) - (7) of the Code
of Ordinances of the City of Denton are hereby amended so that smd section shall hereafter be
and read as follows

The City Council shall set a fee schedule for building permit fees and other inspections
fees by ordinance and the fee schedules shall be available for inspection at the offices of the
Building Official and the City Secretary
SECTION V That Chapter 28, Section 28-28(10) of the Code of Ordinances of the City
of Denton is hereby amended so that said section shall hereafter be and read as follows
(10) Permtt Fee Schedule for New One- and Two-Famdy Dwelhngs
The City Council shall set a fee schedule for new one and two-family dwellings by
ordinance and the fee schedule shall be avmlable for public inspection at the offices of the
Building Official and the City Secretary
SECTION VI That Chapter 28, Sections 28-121(1) - (12) of the Code of Ordinances of
the City 6f Denton is hereby amended so that smd section shall hereafter be and read as follows
Sec 28-121 Inspection fees
The appheant shall submit the applicable elecmcal inspection fees as set by C~ty Counml
by separate ordinance before the ~ssuance of any permit reqmred by th~s dlwslon The fee
schedule shall be, available for public mspectmn at the offices of the Bmldmg Offimal and the
City Secretary
SECTION VII That Chapter 28, Sectmn 28-210(f) of the Code of Ordinances of the
C~ty of Denton is hereby amended so that said section shall hereafter be and read as follows, and
that Section 28-210(g) m hereby deleted
(f) The apphcant shall pay for each permit issued, at the t~me of msuance, a
plumbing permit fee as set by City Counml by ordinance and the fee schedule shall be avmlable
for public inspection at the offices of the Bmld~ng Official and the City Secretary
SECTION VIII That Chapter 28, Sections 28-252(9) and (10) of the Code of Ordinances
of the City of Denton is hereby amended so that smd section shall hereafter be and read as
follows
(9) Mechamcal Permit Fees Table No l-A, Mechanmal Permit Fees ~s amended to
read as follows
The applicant shall submit the apphcable mechanical permit fees as set by City
Council by ordinance and the fee schedule shall be avmlable for pubhc ~nspect~on at the
offices of the Bmld~ng Official and the C~ty Secretary
(10) Table l-A, Other Inspecttons and Fees Table No 1-A ~s amended to read as
follows
The applicant shall submit the applicable ~nspect~ons, re~nspectlon, and plan
review fees as set by City Councd by ordinance and the fee schedule shall be avmlable
for public ~nspectlon at the offices of the Bmldlng Offimal and the C~ty Secretary
SECTION IX That Chapter 28, Section 28-297(3) of the Code of Ordinances of the C~ty
of Denton is hereby amended so that said section shall hereafter be and read as follows
(3) Sectton 1 8, Schedule of Fees Sectmn 1 8 ~s amended to read as follows
The applicant shall submit the apphcable fee for a swimming pool as set by C~ty
Council by ordinance and the fee schedule shall be avmlable for pubhc ~nspectmn at the
offices of the Building Official and the C~ty Secretary
SECTION X. That chapter 28 of the Code of Ordinances, of the City of Denton, Texas ~s
hereby amended by the addition of Section 28-32 to be hereafter read as follows
Sec. 28-32. Exemptions from fees
Not wlthstanchng any other provision of this Chapter or the Building Code, the City of
Denton and any other political subdivision or agency of the State of Texas or the United States
Government shall be exempt from payment of any fees required by this chapter
SE~CTION XI That Ordinances 83-129 and 90-161 of the City of Denton are hereby
repealed
SECTION XH That the Fee Schedules set forth in Exhibit "A", containing Tables i-A,
l-B, 2, 3-A, 3-B, 3-C, 4, 5, and 6, attached hereto and made a part hereof for all proposes, is
hereby adopted and authorized to be imposed for the filing of applications, review, approval,
grant or issuance of permits, inspections, hcenses, certificates, variances or designations required
by the "Buildings and Building Regulatlons"and "S~gn and Advertising Devices" as authorized
by Chapters 28 and 33 respectively, of the Code of Ordinances of the City of Denton
SECTION XIII That this ordinance shall repeal every prior ordinance in conflict
herewith, but only insofar as the portion of such prior ordinance shall be in conflict, and as to all
other sections of the ordinance not m direct conflict herewith, this ordinance shall be and is
hereby made cumulative except as to such prior ordinances or portions thereof as are expressly
repealed hereby
SECTION XIV That if any provision of this ordinance or application thereof to any
person or circumstance is held lnvahd by any court, such holding shall not affect the validity of
the remaining portions of this ordinance, and the City Council of the City of Denton, Texas,
hereby declares that it would have enacted the remaining portions despite any such validity
SECTION XV That this ordinance shall become effective on October 1, 1998, and the
City Secretary is hereby directed to cause the caption of this ordinance to be published twice in
the Denton Record-Chronicle, a daily newspaper published in the C~ty of Denton, Texas, within
ten (10) days of the date of its passage
