1998-283AN ORDINANCE PROVIDING FOR THE EXPENDITURE OF FUNDS FOR
EMERGENCY PURCHASES OF MATERIALS, SUPPLIES OR SERVICES IN
ACCORDANCE WITH PROVISIONS OF STATE LAW EXEMPTING SUCH
PURCHASES FROM REQUIREMENTS OF COMPETITIVE BIDDING, AND
PROVIDING FOR AN EFFECTIVE DATE (PURCHASE ORDER # 87361 TO
AUSTIN WOOD RECYCLING IN THE AMOUNT OF $28,500 00)
WHEREAS, state law and ordinance require that certain contracts reqmnng an
expenditure or payment by the City m an amount exceeding $15,000 be by competmve
bids, except in the case of pubhe calamity where ~t becomes necessary to act at once to
appropriate money to reheve the neeesmy of the e~tazens of the c~ty, or in case of
unforeseen damage to public property, maehmery or eqmpment, and,
WHEREAS, the City Manager has recommended to the City Council that ~t is
necessary to purchase goods or serwees due to the following emergency conditions
outhned in the memorandum attached hereto as Exhibit "A", incorporated herein by
reference, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the City Council hereby determines that there ~s a pubhc calamity
that makes ~t necessary to act at once to appropriate money to reheve the necessity of the
emzens, or to preserve the property of the c~ty, or to protect the pubhc health of the
mtlzens of the city, or to provide for unforeseen damage to pubhc property, maehmery or
eqmpment, and by reason thereof, the followxng emergency purchases of materials,
equipment, supplies or servmes, as described m the "Purchase Orders" attached hereto,
are hereby approved

prow$1ons of state law exemptmg such purchases by the City from the reqmrements of
competitive bids

SUBJECT AUSTIN WOOD RECYCLING EMERGENCY PURCHASE
ORDER
The Water Reclamation Division is requesting approval for the expenditure of $28,500
on an emergency basis These funds w~ll be used to contract vath Austin Wood
Recycling to complete gnn&ng of a stockpile of wood waste located on top of the
landfill Austin Wood Recycling Is currently on site and all of their eqmpmem has been
mobilized to gnnd 8,336 yards of the emstmg yard waste at a cost of $1 50/cubic yard
These additional funds would provide for gnndmg the balance of 19,000 yards of wood
waste
Heavy flows of wood waste, problems with the Water Reclamation divts~ons tub gnnder
and the need for wood mulch at the landfill site prompted the diversion of wood waste to
the landfill The original plan was to divert approximately 10,000 yards of wood waste to
the landfill Flows of wood waste had been arnvmg at approximately 4,500 yards per
month When 9,000 yards of waste had accumulated the landfill initiated the process to
locate an outside gnnding company Delays in contract scheduling and with parts
shipment needed for repmrs on the Water Reclamation Divisions tub gnnder required that
brush continued to be diverted to the landfill What was not anUclpated was the huge
influx of construction debris during the middle of July to the middle of August Brush
was diverted for a total of 13 weeks In the first 6 weeks approximately 9,000 yards of
wood waste were received and dunng the last 7 weeks approximately 18,000 yards were
received We think this increase was due to a large number of new homes finishing up
the framing portion of construction at similar times and their resulting site clean up

This large stockpile of wood waste poses a significant fire hazard and TNRCC inspection
concerns The increase in woodwaste associated with development has demonstrated that
our current gnnder is to small to handle the wood wastestream To prevent future
reoccurrence of this problem the Water Reclamation Division will bid out contract
gnndmg for one year to assist gnndmg the wood waste above the division's current
capacity In addition, the division will be evaluating the possible need of a rate increase
for wood waste to help offset the cost of the gnnding operation and will be evaluating the
purchase of a larger tub gnnder to handle the increase m volume
