AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM
PD-104 ZONING DISTRICT CLASSIFICATION TO AGRICULTURE (A) AND OFFICE (O)
ZONING DISTRICT CLASSIFICATIONS AND USE DESIGNATIONS FOR 18 008 ACRES OF
LAND LOCATED ON THE SOUTHEAST CORNER OF HOBSON LANE AND F M 1830
(COUNTRY CLUB ROAD), PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT
OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Dawd Vandeflaan, as Broker/RepresentaUve, on behalf of Charles N Daws, has
apphed for a change m zomng for 18 008 acres of land from PD-104 zoning d~smct class~cat~on and
use des, gnatlon to Agriculture (A) and Office (O) zomn$ dlstnct class~finat~ons and use des,gnat,ohs,
and
WHEREAS, on August 26, 1998, the Planmng and Zomng Comm, ss~on recommended
approval oftha requested change m zomng, and
WHEREAS, the C,ty Counc, l finds that the change m zomng will be m comphance w~th the
1988 Denton Development Plan and the 1998 Denton Plan Pohc, es, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the zomng d~stnct class,finat,on and use designation of the 18 008 acre
tract of land described m the legal descnptlon attached hereto and incorporated here~n as Extub~t &
~s changed from PD-104 zomng district classification and use des~gnauon to Office Conditioned
[O(c)] zomng d~stnct for the area of Lot 1 as described m Extublt B wluch is attached and
incorporated herean, and the rem0ander ts changed from PD-104 zomng &strict classtficauon and use
destgnatton to Agriculture (A) zomng d~stnct class~ficauons and use deslguat~ons, under the
comprehensive zomng ordinance of the Qty of Denton, Texas That the area zoned as Office
Condmoned [O(c)] shown as Lot 1 in Erdubat B ~s subject to the followang condttmns
Condmons of Office [O(e)] zomng class~ficatmn, I That the uses descnbed ~n Exhibit C shall be prohibited w~th~n th~s d~str~ct, ~n
addition to those uses ordinarily prohibited by the Office (O) zoning district
classification
2 That the total floor area for all buildings on the 1 981 acres shall not exceed twenty
thousand (20,000) square feet
3 That no loading docks be permitted
4 That the exterior walls of all buildings shall be constructed of not less than seventy
percent br~ck or masonry materials
5 That no "off-pmm~se" signs (as defined by section 33-2 of the Code of Ordinances
of the C~ty of Denton) shall be permitted
6 That no direct off-site hght~ng shall be permitted
7 A bufferyard, measunng fifteen (15) feet w~de and compns~ng of four (4) canopy and

percent
11 No parking shall be allowed m the front yard setback of any building along
Country Club Rd or Hobson Lane

~ That any person wolatmg any prows~on of tMs ordinance shall, upon
conv~cUon, be fined a sum not exceeding $2,000 00 Each day that a prov~ston ofth~s ordinance ~s
wolated shall constitute a separate and d~sunet offense
~ That th~s ordinance shall become effecuve fourteen (14) days from the date
of*ts passage, and the C~ty Secretary ~s hereby d~rected to cause the capUon oftMs ordinance to be
pubhshed trace m the Denton Record-Chromcle, a daffy newspaper pubhshed m the C~ty of Denton,
Texas, w~thm ten (10) days of the dato or,ts passage
