1998-351AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AUTHORIZING A 3OINT PUBLIC HEARING WITH THE PLANNING AND ZONING COMMISSION AND THE CITY COUNCII~ TO BE HELD ON NOVEMBER 17, 1998 PURSUANT TO TEXAS LOCAL GOVERNMENT CODE §211007 (b) AT THE CITY COUNCIL CHAMBERS AT 6 O'CLOCK PM TO CONSIDER RECOMMENDATION AND ACTION UPON AN ORDINANCE CREATING A CORRIDOR OVERLAY DISTRICT, PRESCRIBING NOTICE OF THE ]OINT MEETING PURSUANT TO TEXAS LOCAL GOVERNMENT CODE §211 007 (d) BY RUNNING NEWSPAPER AD AND MAILING NOTICE TO OI~NERS V~ITHIN THE PROPOSED DEFINED CORRIDOR BOUNDARIES, AND PROVIDING FOR AN EFFECTIVE DATE W]~IEREAS, the Denton City Council has determined that comdors impact the visual ]ma§e of the commumty, and WHEREAS, the Denton City Council has requested that the City P]anmng and Deve]opmant Staff develop a Corridor Overlay District Ordinance, and VvTrI]~REAS, the Denton City Council desires to have a 3omt pubhc heanng, pursuant to Texas Loea]lGovemment Code §211 007, with the Planmng and Zoning Commission re§ardmg the orthn~nc~ creatlilg a Comdor Overlay District on November ]7, 1998 at the City Council Chambers at 6 o'clock p m, and V~IEkEAS, the Denton City Council wishes to prescribe notice of the time and place of the joint publl~ heknng in a manner that 18 efficient and economical, and W~:IEREAS, kY a two-thirds vote of the City Council, pursuant to Texas Local Government Code 4211 007 (d), prescribed that notice of the joint public heanng shall be aeeomph~hed by punishing a newspaper ad and by mailing notice to each real property owner, as indicated by the n~ost recently approved munlcapal tax roll, wlthm the proposed defined corridor boundaries of the proposed ordinance which is attached as Exhibit A, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS ~ That the Denton C~ty Council and the City of Denton Planmng and Zoning Commms~on shall conduct a joint public heanng pursuant to Texas Local Government Code §211 007i on November 17, 1998 at the City Council Chambers at 6 o'clock p m to consider, make recommendation, and take any appropriate action concerning a proposed ordinance to create a Comdor Overlay Dmtnet ~ That the notice of the time and place for the joint public heanng on November 17, 1998 shall be given by placing an ad in the Denton Record-Chronicle and by marling individual notice to each real property owner, as indicated by the most recently approved mumclpal tax roll, w~ttnn the proposed defined comdor boundaries of the proposed ordinance, whmh is attached and incorporated herein as Exhibit A That the notices shall be sent or published at least ten days before the proposed joint public heanng ~ That th~s ordinance shall become effective ~mmedlately upon its passage and approval PASSED AND APPROVED this the ~__~day of ~~ ,1998 JAC~ ATTEST JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY PAGE 2 Exhibit A CORRIDOR CLASSIFICATIONS · Gateway Corridors Gateway comdors are 1,000-feet wide overlay zones that extend 500 feet from the right- of-way center line for the following hmlted-access thoroughfares * 1-35 N, · 1-35W, · 1-35 E, and · Loop 288 · Entranceway Corridors Entranceways comdors are 500-feet wide overlay zones that extend 250 feet from the right-of-way center line for the following segments of primary or secondary thoroughfares · U S Highway 380 from Primrose Street west to the c~ty limits, · U S H~ghway 380 from Ruddell Street east to the city hm~ts, · US Hwy 77 from 1-35N to Windsor Drive, · Teasley Lane (FM 2181), · Fort Worth Drive (US Highway 377) from 1-3515 south to the city limits, · Locust Street (FM 2164) from Loop 288 north to the city hm~ts, and · Sherman Drive (FM 428) from Loop 288 north to the city limits · ,C~ty limits: The regnlat~ons shall apply to property along the designated roadway that ~s ,wlttun the c~ty lamts As annexation occurs along the designated roadways the regulations shall apply to the area annexed
