1998-374AN ORDINANCE CANVASSING THE RETURNS AND DECLARING RESULTS OF A
SPECIAL MUNICIPAL ELECTION HELD IN THE CITY OF DENTON ON NOVEMBER 3,
1998 REGARDING THE EXTENDED HOURS FOR THE SALE OF ALCOHOLIC
BEVERAGES, AND PROVIDING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ The City Council finds and declares that the November 3, 1998 special
mumclpal electron was duly ordered for the purpose of determlmng whether an ordinance would
be adopted estabhshmg a standard hours area for the sale of m~xed beverages, beer, and w~ne,
wtuch would effectively repeal the current extended hours for the sale of alcoholic beverages
ordinance, that proper notme of smd electron was duly g~ven and elect~on officmls appmnted,
that the electron was duly held and the returns of the electron officials have been dehvered to the
Council, all m accordance w~th the laws of the State of Texas and the Charter and ordinances of
the C~ty of Denton
~ The offieml returns of the elect~on officials having been opened, examined,
and canvassed, and the Cotmcfl hereby finds and declares that 13,315 ballots were east at the
election, and that the votes east for or against the ordinance and the propommn set forth below
were as follows
THE ADOPTION OF AN ORDINANCE ESTABLISHING A STANDARD HOURS AREA
FOR THE SALE OF MIXED BEVERAGES, BEER, AND WINE ON PREMISES WITHIN
THE INCORPORATED LIMITS OF THE CITY OF DENTON, SAID HOURS TO BE
BETWEEN 7 00 A M AND MIDNIGHT ON ANY DAY, EXCEPT SUNDAY ALCOHOLIC
BEVERAGE SALES ARE PERMITTED BETWEEN MIDNIGHT AND 1 00 A M AND
BETWEEN 10 00 A M AND MIDNIGHT ON SUNDAYS, EXCEPT THAT AN ALCOHOLIC
BEVERAGE SERVED TO A CUSTOMER BETWEEN 10 00 A M AND 12 00 NOON ON
SUNDAY MUST BE PROVIDED DURING THE SERVICE OF FOOD, PURSUANT TO
APPLICABLE PROVISIONS OF CHAPTER 105 OF THE TEXAS ALCOHOLIC
BEVERAGES CODE

AGAINST THE ORDINANCE 2,476 votes
TOTAL ELECTION DAY VOTES CAST
FOR THE ORDINANCE 3,262 votes

~ The Council finds and declares that, as a result of the elect~on, the
ordinance establlslung a standard hours area for the sale of m~xed beverages, beer, and wine on
premises w~thm the incorporated limits of the C~ty of Denton ~s hereby declared to be defeated
and repealed, and the cun'ent Ordinance No 96-014 estabhshmg extended hours for the sale of
m~xed beverages, beer, and wine shall remmn in full force and effect
~ That this ordinance shall become effective lmmedmtely upon ~ts passage
and approval
