AN ORDINANCE ABANDONING A CERTAIN 16 FOOT DRAINAGE EASEMENT
CONSISTING OF 1,924 SQUARE FEET OF LAND ON THE EAST SIDE OF BRIDGES
ROAD, APPROXIMATELY 535 FEET NORTH OF SPENCER ROAD, SITUATED WITHIN
PROPERTY RECORDED IN THE DEED RECORDS OF DENTON COUNTY, TEXAS AT
VOLUME 960, PAGE 723, AND DESCRIBED AS A PART OF THE M E P & P RR
SURVEY, ABSTRACT 927, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the C~ty of Denton has received a request for the abandonment of a certmn
drmnage easement m consideration of the conveyance of a new drmnage easement, and
WHEREAS, the Plarmlng and Zomng Commission of the C~ty of Denton, Texas
reviewed the requested abandonment and recommended approval, and
WHEREAS, the Council of the C~ty of Denton, Texas has detenmned that the drmnage
easement being vacated ~s not needed for pubhc use s~nce the ex~stlng drmnage ~mprovements
are situated wxthln the new drmnage easement being conveyed, and
WHEREAS, the fmr market value of the drmnage easement has been determmed and
received, as reqmred by section 272 001 of the Texas Local Government Code, NOW,
THERFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the 16 foot drmnage easement described ~n Exhibit A, attached hereto
and incorporated herem by reference, consisting of 1,924 square feet of land on the east s~de of
Bridges Road, approximately 535 feet north of Spencer Road and recorded m the Deed Records
of Denton County, Texas at Volume 960, Page 723, and described as a part of the M E P & P
RR Survey, Abstract 927, m permanently vacated and ext~ngmshed as a pubhc easement, to the
extent described m smd extub~t
~ That by reason of such vacation the C~ty of Denton's property ~nterest ~n
the vacated port~on of smd easement shall, by operation of law, revert to the owner or owners
abutting the easement here~n abandoned, and the C~ty of Denton releases any and all clmms to
the use of the vacated pomon of smd property as a pubbc easement
SECTION III That this ordinance shall become effective ~mmedlately upon ~ts passage
and approval
