AN ORDINANCE PROVIDING FOR THE EXPENDITURE OF FUNDS FOR
PURCHASE OF MATERIALS, SUPPLIES AND SERVICES FOR THE PURPOSE OF
MAINTAINING A KODAK IS 70 NCEA COLOR COPIER WHICH ARE
AVAILABLE FROM ONLY ONE SOURCE IN ACCORDANCE WITH THE
PROVISIONS OF STATE LAW EXEMPTING SUCH PURCHASES FROM
REQUIREMENTS OF COMPETITIVE BIDS, AND PROVIDING AN EFFECTIVE
DATE (PURCHASE ORDER # 90834 TO DANKA IN THE AMOUNT OF $26,760 00
PER YEAR, TOTAL AWARD $80,280 00)
WHEREAS, Section 252 022 of the Local Government Code provides that
procurement of ~tems that are only available from one source, including, Items that are
only avmlable from one source because of patents, copyrights, secret processes or natural
monopohes, films, manuscripts or books, electricity, gas, water and other utthty
purchases, captive replacement parts or components for equipment, and hbrary materials
for a pubhc hbrary that are available only from the persons holding exclusive thstnbut~on
rights to the materials, need not be submitted to competitive b~ds, and
WHEREAS, the C~ty Council wishes to procure one or more of the ~tems
mentaoned m the above paragraph, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the following purchase of materials, equipment or supphes, as
descnbed an the "Purchase Orders" attached hereto, are hereby approved

~ECTION II That the acceptance and approval of the above atems shall not
constitute a contract between the C~ty and the person submitting the quotation for such
~tems until such person shall comply wath all requirements specified by the Purchasang
Department

contracts relating to the ~tems spemfied m Section I and the expendature of funds pursuant
to smd contracts ~s hereby authorized
SECTION IV That this ordinance shall become effective immediately upon its
passage and approval
