1998-433AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 28 OF THE CODE OF
ORDINANCES OF THE CITY OF DENTON. TEXAS ("BUILDING CODE") TO PROVIDE
FOR ADOPTION OF THE 1997 UNIFORM BUILDING CODE WITH CERTAIN
AMENDMENTS, PROVIDING FOR A SEVERABILITY CLAUSE, PROVIDING A
SAVINGS CLAUSE, PROVIDING FOR A PENALTY IN THE AMOUNT OF $2000 00 FOR
VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That Section 28-27 of Article II of Chapter 28 of the Code of Ordinances
of the City of Denton, Texas, is hereby amended to read as follows
See 28-27. Adoption of building code.
The Uniform Building Code, 1997 Edition, Volumes 1,2, and 3, as published by the
International Conference of Building Officials, a copy of which shall be filed in the office of the
city secretary and available for public inspection, is hereby adopted and designated as the
building code of the city, same as though that edition of such code were copied at length herein,
subject to the deletions and amendments enumerated in section 28-28
Sec. 28-28. Deletions and Amendments.
The followmg sections of the building code adopted by Section 28-27 are amended to read as
follows
(1) Section 105, Board of Appeals Section 105 ts deleted
(2) Section 106 1, Permits Required Section 106 1 is amended to read as follows
Except as specified in subsection 106 2 of this section, no budding or structure regulated
by this code shall be erected, constructed, enlarged, altered, repaired, moved, improved,
removed, converted or demolished unless a permit for each braiding or structure has first
been obtamed from the building official A single budding permit may be issued for all
buildings within an apartment complex A separate electrical, plumbing, mechanical &
one (1) driveway approach permit shall not be reqmred when a building permit for a new
one- or two- family dwelling or for a new apartment complex is Issued
(3) Section 106 4 2 Retention of plans Section 106 4 2 is amended by adding the following
exception

The applicant shall submtt the applicable permit fee as set forth by City Council be
separate ordinance, avadable for public mspectton at the offices of the Building Official
and the Ctty Secretary
(5) Section 107 3, Plan Review Fees Section 107 3 is amended to read as follows
The applicant shall subma the apphcable plan review fee as set forth by City Council by
separate ordinance, available for public inspection at the offices of the Building Official
and the City Secretary
(6) TableNo 1-A, ButldmgPermttFees Table 1-A ls amended to read asfollows
The applicant shall submit the applicable permit fee as set forth by City Council by
separate ordinance, available for public inspection at the offices of the Building Official
and the City Secretary
(7) Section 302 4, Fire Ratings for Occupancy Separattons, Exception Item (3) Section
302 4 Exception Item (3) is amended to read as follows
3 In the one-hour occupancy separation between a Group R, Dlmsion 3 and Group U
Occupancies, the separation may be limited to the installation of not less than one-half
inch thick gypsum board construction on the garage side and a weather-stripped door will
be permitted in lieu of a one-hour fire assembly Fire dampers shall not be required in
ducts penetrating this separation for ducts constructed of not less than No 26 gauge
galvanized steel
(8) Section 307 11 3, Exit corridors Section 307 11 3, Exception Part 3 is amended to read
as follows
3 Spnnkler protection shall be designed in accordance with the latest edition of N F P A
Standard 13 for Ordinary Hazard Group 2
(9) Section 403 2 1, System Design Section 403 2 1 is amended changing the first sentence
to read as follows
The automatic sprinkler system shall be provided throughout the building as specified by
the latest edition of N F P A Standard 13 for group B office buildings Group R,
Division l(apartments & congregate residences over ten persons) buildings may use
either N F P A Standard 13 or N F P A Standard 13R Group R, Division 1 (hotels &
motels) shall provide a N F P A Standard 13 system
(10) Section 404 3 1, Automattc Sprinkler System Section 404 3 1 is amended by changing the
first sentence to read as follows
The covered mall building shall be provided w~th an automatic sprinkler system
conforming to the provisions of the latest edition ofN F P A Standard 13
(11) Section 405 1 1, Standards of Quah(y Section 405 1 1, Part 4 is amended to read as
follows

(12) Sectton 503 2 1, General Sectxon 503 2 1 ~s amended by changing last sentence of
paragraph to read as follows
The above provismons shall not apply to walls at right angles to the property hne, or to
Group A, D~v~s~on 3 and 4 and Groups B,F,M,S and R Occupancxes whmh are equipped
throughout with approved automatic fire spnnkler systems and are at least ten (10) feet
from property lines

classffioation rating may be reduced one classification, but ~n no case shall

automatic sprinklers complying w~th the latest editions of N F P A Standard 13,

paragraph, and by amending parts 1 and 2 to read as follows

1 An automatic sprinkler system shall be ~nstalled ~n all new braiding of
noncombustible constructton (Type I or II) which exceed three stones m height or
which have more than ten thousand (10,000) square feet of floor area
2 An automatic sprinkler system shall be installed tn all new buildings of
combustible construction (Type III, IV or V) which exceed three stones m height
or which have more than seven thousand five hundred (7,500) square feet of floor
area
3 The owner(s) of any bmld~ng shall be reqmred to ~nstall an automattc sprmkler
system at such time as the owner(s) construct an addition, when combtned w~th
the total square footage of all previous addit~ons and enlargements to the braiding,
exceeds ten thousand (10,000) square feet of total floor area, and when the total
square footage of all such addlUOns exceeds by more than twenty-five (25)
percent of the original floor area

than that required under N F P A Standard 13 latest edition for the occupancy hazard

(24) Sectton 1004 3 4 3 Constructton Section 1004 3 4 3 is amended by adding

Groups A, Division 3 and 4, B,F,M,S and R Occupancies which do not exceed three (3)
stones in height and are equipped with an approved automatic sprinkler system
throughout
(25) Sectton 1004 3 4 3 2 2 Windows Section 1004 3 4 3 2 2 is amended by adding an
exception to read as follows
1 In comdor walls of Groups A, D~visions 3 and 4, B,F,M,S and R occupancies, which
do not exceed three (3) stones m height and are eqmpped w~th an approved automatic
spnnkler system throughout
(26) Sectton 1003 2 9 2 Power supply Section 1003 2 9 2 is amended by changing the first
paragraph to read as follows
The power supply for exit illumination shall normally be provided by the premises'
wiring system In the event of its failure, illumination shall be automatically provided
from an emergency system for Group I, Division 1 I and 1 20ccupanctes All other
occupancies requiring more than one (1) exit shall provide exit illumination as required m

Exception Group R, Division 1 Apartment Buildings
L~sted below are the minimum reqmrements for apartment buildings
a Exterior bottom plates shall be sealed w~th construction adhesive, caulking or
approved materials
b All exterior walls shall be ~nsulated with an insulation having a m~mmum R-15
value
c Attic areas shall be insulated with insulation having a mlmmum R-30 value where
electric resistance heating ~s used and a mlmmum R-26 value where other heating
methods are used
d All exterior windows and shding glass patio doors shall have double glazing
(28) Section 1501 1 General Secuon 1501 I ts amended by adding a new paragraph
and an exception between the third and fourth paragraphs to read as follows
Untreated or flre-retardant treated wood shingles or shakes shall be prohibited
Exception The roof covering on existing dwelhngs and structures with wood shingles or
shakes may be repaired with factory treated fire-retardant wood shmgles or shakes or
additions to these structures may be made with factory treated fire-retardant wood
shingles or shakes
(29) Section 2902 3, Groups B,F,H,M and S Occupancies Section 2902 3 is amended by
adding two (2) new paragraphs followmg the first paragraph to read as follows
In the following Group A Occupancies, water closets shall be provided at a rate of two
(2) water closets for the use of females to each water closet for the use by males arenas,
stadmms, commumty and convention halls, specialty event centers and amusement
facilities
Retail stores and office type occupancies having not more than fifteen employees shall be
provide at least one (1) unisex handicap water closet
~ That if any provision of this ordinance or the application thereof to any
person or circumstances is held invalid, such invalidity shall not affect other provisions or
applications, and to this end the provisions ofthts ordinance are severable
SECTION III That all provisions of the ordinances of the City of Denton in conflict with
the prowsions of this ordinance are hereby repealed, and all other provisions of the ordmances
of the City of Denton, not m conflict with the provisions of this ordinance, shall remain In full
force and effect Nothxng m th~s ordinance shall be construed to change or invalidate any fee
schedule premously passed by the C~ty Council affecting Chapter 28, City of Denton, Code of
Ordinances
SECTION IV. That any person vtolating any provlston of this ordinance shall, upon
convmt~on, be fined a sum not to exceed two thousand dollars ($2000 00) Each day that a
provision of this Ordinance is violated shall constitute a separate and distinct offense
~ That th~s ordinance shall become effective fourteen (14) days from the
date of its passage, and the City Secretary is hereby directed to cause the caption of this
ordinance to be pubhshed twine in the Denton Record Chronicle, the officml newspaper of the
Cay of Denton, Texas, w~thm ten (10) days of the date of its passage
