AN ORDINANCE PARTIALLY VACATING A PORTION OF A CERTAIN ALLEY
EASEMENT RECORDED IN THE DEED RECORDS OF DENTON COUNTY, TEXAS AT
VOLUME 318, PAGE 4, AS IT PERTAINS TO THE WEST HALF OF A 20-FOOT WIDE
ALLEY IN BLOCK 12 OF THE COLLEGE VIEW ADDITION TO THE CITY OF DENTON,
AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the Caty of Denton has received a request for the abandonment of a pomon
of an alley easement, and
WHEREAS, the Planning and Zoning Commission of the City of Denton, Texas
reviewed the requested abandonment and recommended approval, and
WHEREAS, the Council of the City of Denton, Texas has determined that the port,on of
the alley easement being vacated is no longer needed for public use, and
WHEREAS, the fmr market value of the portion of the alley easement being abandoned
has been determined and received, as requu'ed by Section 272 001 of the Texas Local
Government Code, NOW THERFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the real property described m Exhibit "A', attached hereto and
incorporated hereto by referenced, being a port~on of the alley easement recorded m Volume
318, Page 4 of the Deed Records of Denton County, Texas, as it pertains to west 10 feet of the
existing 20-foot alley easement adjacent to Lots 1 and 2 of Block 12 of the College View
Addition, an addition to the City of Denton, Denton, County Texas, is permanently vacated and
extmgmshed as a public alley easement, to the extent described m said exhibit
~ The portion of the public alley described m Exhibit "A" is hereby vacated
and abandoned as a public alley only and expressly reserving utility easement rights for access,
drainage, and public utilities which are manifest m the dedication of a public alley
SECTION III That by reason of such vacation the City of Denton's property interest in
the vacated portion of smd alley easement shall, by operation of law, revert to the owner or
owners abutting the easement hereto abandoned, and the City of Denton releases any and all
clmms to the use of the vacated pomon of smd property as a public easement
SECTION III That this ordinance shall become effective munedmtely upon its passage
and approval
