APPROXIMATELY 96 FEET EAST OF HETTIE STREET, PROVIDING FOR A PENALTY
IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, PROVIDING
A SAVINGS CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Nancy Jessee, property owner, has applied for a change m zomng for 155
acres of land to alter the existing conrhtlons on the current Office Conditioned [O(c)] zomng, and
WHEREAS, on November I1, 1998, the Planning and Zoning Comm~ssion
recommended approval of the requested change in zoning, and
WHEREAS, the City Council finds that the change in zonmg will be in compliance with
the 1988 Denton Development Plan and the 1998 Denton Plan Pohc~es, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAiNS
SECTION I That the zoning district classification and use designation of the 155 acre
property described m the legal description attached hereto and ~ncorporated herein as Exhibit A
remmns Office Conditioned [O(c)] under the comprehensive zoning ordinance of the City of
Denton, but the exmt~ng conditions are repealed and the following conditions are added
1 Use of any structure ~s limited to offices, professional or adm~mstrat~ve
2 Llghtmg on the property shall be designed and malntmned so as not to slune on,
or otherwise disturb, adjolmng property or to sh~ne and project upward to prevent
the chffuslon ~nto the night sky
3 The maximum height of any structure shall not exceed two and a half (2 5)
stol'les
4 The maximum floor area of the office ~s hm~ted to 3500 square feet
SECTION II That the City's official zomng map is amended to show the change ~n
zoning d~stnct classfficatlon
SECTION III That any person violating any prows~on of this ordinance shall, upon
convmtmn, be fined a sum not exceedmg $2,000 00 Each day that a provision of tlns ordinance
~s violated shall constitute a separate and d~st~nct offense
SECTION IV That Ordinance No 96-002, as amended, shall remain ,n full face and
effect, save and except as amended by ttus orchnance
SECTION V That this ordinance shall become effective fourteen (14) days from the
date of its passage, and the City Secretary is hereby directed to cause the caption of this
ordinance to be published twice in the Denton Record-Chromcle, a dmly newspaper published in
the City of Denton, Texas, within ten (10) days of the date of its passage ~
