1998-443AN ORDINANCE OF THE CITY OF DENTON, TEXAS DONATING CERTAIN
HISTORICAL ARTIFACTS TO DENTON COUNTY, TEXAS, TO BE HELD IN THE PUBLIC
INTEREST AS PUBLIC PROPERTY, RESERVING THE RIGHT TO RECLAIM THE
ARTIFACTS IN THE EVENT THAT DENTON COUNTY IS UNWILLING OR UNABLE TO
PRESERVE, MAINTAIN OR DISPLAY THEM FOR THE BENEFIT OF THE PUBLIC, AND
PRESCRIBING AN EFFECTIVE DATE
WHEREAS, on June 4, 1998, the City of Denton entered into a mediated settlement of
htigation styled Denton County Htstortcal Museum, Inc v Denton County and Ctty of Denton (the
"Lmgation") entered by the Court on August 21, 1998, which concerned, in part, the disposition of
certain tustoncal artifacts, and
WHEREAS, the City of Denton, Texas reclamed title to a number of these historical
artifacts, both as a result of stipulated agreement, and as a result of a declaratory judgment rendered
by the Probate Court of Denton County Texas on November 12, 1998, said reclmmed artifacts
being described m Exhibit A (the "Artifacts"), and
WHEREAS, the Council of the City of Denton, Texas desires to donate these Artifacts to
Denton County, Texas, subject only to a stipulation that they be preserved and displayed by this
governmental entity for the benefit of the public as a part of the County's museum, NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the Artifacts hsted in Exhibit A are hereby donated to Denton County,
Texas, subject only to a stipulation that they be preserved, displayed, and maintained by this
governmental entity for the benefit of the public as a part of the County's museum
SECTION II That the City of Denton, Texas expressly reserves its right to reclaim
ownership of the Artifacts in the event that Denton County, Texas is unwilling or unable to
preserve, display, or mmntmn these Artifacts for the benefit of the public as a part of the County's
museum, or m the event that Denton County, Texas shall ever lose ownership, possession or control
of the artifacts, voluntarily or involuntarily, by any attempted gift, assignment, execution,
attachment, court decision, seizure, or m any other fashion
SECTION III That this ordinance shall become effective immediately upon its passage and
approval
