1997-003Z-96-053 ORDINANCE NO. AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM THE NEIGHBORHOOD SERVICE (NS) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION TO THE GENERAL RETAIL CONDITIONED (GR[c]) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR LOT 3, BLOCK A, OF THE REPLAT OF LOT 3, BLOCK A, OF THE TEASLEY MALL SUBDIVISION, LOCATED ON THE SOUTH SIDE OF LONDONDERRY, APPROXI- MATELY 200 FEET WEST OF TEASLEY LANE, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Roy Metzler, on behalf of Kathy Orr and Suzanne Frlckey, owners of the sub3ect property, Initiated a change in zoning for Lot 3, Block A, of the Replat of Lot 3, Block A, of the Teasley Mall Subdivision from the Neighborhood Service (NS) zoning d~strlct classification and use designation to the General Retail (GR) zoning district classification and use designation, and WHEREAS, on December 11, 1996, the Planning and Zoning Commlssion recommended approval of a change in zoning from the Neighborhood Servlce (NS) zoning district classification and use designation to the General Retail Conditioned (GR[c]) zoning district classification and use designation, and WHEREAS, the C~ty Council finds that this change in zoning district will be in compliance with the Denton Development Plan; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS. SECTION I. That the zoning district classification and use deslgnatlon of Lot 3, Block A, of the Replat of Lot 3, Block A, of the Teasley Mall Subdivision ~s hereby changed from the Neighborhood Service (NS) zoning district classification and use designation to the General Retail Conditioned (GR[c]) zoning dlstrlct classification and use designation under the compre- hensive zoning ordinance of the City of Denton, Texas, subject to the following condltlon' 1. That the following uses shall be prohibited within this district, in addition to those ordinarily prohibited by the General Retail classification, or any other condition listed herein, Dance Hall or Night Club, Sexually Oriented Business, Gaso- line Service Station, Licensed Private Club S~CTION II. That the City's official zoning map ~s amended to show the change ~n zoning district classification SECTION III. That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceed- lng $2,000.00. Each day that a provision of this ordinance violated shall constitute a separate and distinct offense SECTION IV. That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordi- nance to be published twice in the Denton Record-Chronicle, the offlclal newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED, this the ~ day of~, 1997.
