18, 1997 TO DETERMINE WHETHER THE VOTERS WOULD APPROVE OPTION OF
AODITIONAL ONE-H F OF ONE PERCENT SALES AND USE T WITH N THE
CITY TO BE USED FOR THE PROMOTION AND DEVELOPMENT OF NEW AND
EXPANDED BUSINESS ENTERPRISES, AND PROVIDING AN EFFECTIVE DATE
WHEREAS, on November 5, 1996, the City Council ordered an
election to be held zn the City of Denton, Texas on January 18,
1997 to determzne whether the C~ty would adopt a one-half of one
percent sales and use tax within the City to be used for the
promotion and development of new and expanded buszness enterprises
under Sectzon 4A of the Development Corporation Act of 1979,
Section 5190 6 of Vernons Ann Tex C~v Stat , and
WHEREAS, the C~ty Council has ~nvestlgated all matters
pertaining to said election, zncludlng the ordering, gzvlng notice,
appointment of officers, holding and making returns of said
election, and
WHEREAS, the election officers that held said elect~on have
duly made the returns of the result thereof, and sa~d returns have
been duly delzvered to the Czty Council for off~czal canvassing of
the returns thereof, and
WHEREAS, the elect~on was held ~n accordance w~th the autho-
rized procedure and was ~n all respects legally held after proper
not~ce had been gzven, and the returns were duly and legally made,
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON, HEREBY ORDAINS
SECTION I That all of the recitals contained in the preambles
of this ordinance are found to be true and correct and are adopted
as fzndzngs of fact by the C~ty Council as part of its official
record
SECTION II That the City Council offlczally finds, deter-
mines, and declares that the January 18, 1997 special municipal
election was duly ordered for the purpose of determlnzng whether
the City would adopt an additional one-half of one percent sales
and use tax wlthln the City to be used for promoting and developing
new and expanded business enterprzses under Section 4A of the
Development Corporation Act of 1979, that said election was duly
ordered, that proper not~ce of this elect~on was duly g~ven, that
proper elect~on officers were duly appointed prior to sa~d
elect~on, that the election was duly held, that the returns of the
result of this election have been made and delivered, and that the
City Council has duly canvassed said returns, all zn accordance
with the law and the ordznance calling said elect~on
SECTION III That the offlclal returns of the election
officials hav~ng been opened, examined, and canvassed, the City
Council hereby f~nds and declares that 6,223 ballots were cast at
the election, and that the votes were properly cast
SECTION IV That the City Council officially finds and
determlnes that the following votes were cast at said election on
the submItted propositIon by the resident, qualified electors of
sa~d City who voted at the election

assessed, and collected as voted and mn accordance with all
requzrements of the law
