THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: ~ That Ordinance No. 97-052 is hereby amended by adopting a new CWM Rate Schedule, attached hereto and incorporated herein as Exhibit A, for the sale of compost and wood mulch, as provided for in Chapter 26 of the Code of Ordinances of the city of Denton, Texae ~ That if any section, subsection, paragraph, sentence, clause, phrase, or word in this ordinance, or application thereof to any person or circumstances is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the city Council of the city of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such Invalidity. ~ That the amendment to the Schedule of Rates herein adopted shall be effective, charged and applied retroactlve- ly, as applicable, to the sale of compost and wood mulch by the Water Reclamation Division of the Wastewater Department of the City of Denton on or after March 1, 1997; and a copy of said rates shall be maintained on file ~n the office of the C~ty Secretary. All compost and wood mulch sold will be sold in bulk, and will not be bagged or otherwise packaged. Ail customers w~shing to purchase compost and wood mulch will be required to pay for same, prior to being entitled to receive any compost or wood mulch. Ail compost and wood mulch sold shall be provided to the customer at the Plant once the customer presents a paid receipt to the attendant. No product deliveries will be made to any cus- tomer's site location at this time. Also applicable for wastewater service without City of Denton water service. Not applicable for sub-billing or other utility billing by service user in any event. NET MONTHLY RATE - WITH CITY OF DENTON WATER SERVICE (1) Facility Charge $6.20 / 30 days (2) Volume Charge $2.37 / 1,000 gallons effluent Except as otherwise stated in this schedule, wastewater volume is calculated based upon a historical winter Average Daily Usage, established annually during the billing months of December through February, and based upon actual water consumption during those months. The historical Average Daily Usage thus calculated establishes the wastewater volume charge for each subsequent month, through the following February, unless the actual monthly Average Dally Usage is lower than the historical Average Daily Usage. If, for any month, the actual Average Dally Usage is lower than the historical Average Dally Usage, then the actual Average Dally Usage wlll be used to calculate the wastewater bill for that month. For customers possessing lnsufflcient water consumption billing history to establish a historical Average Daily Usage, wastewater volume is calculated based upon the current month's water consumption, tied to a fixed maximum volume. A. For customers with an established historical water consumption billing history for the preceding billing months of December through February, the Average Dally Usage applicable through the following February shall be calculated at 98% of the current average dally water consumption for the preceding billing months of December through F~bruary, subject to the following exception: 1. If the current monthly Average Dally Usage so calculated during any winter billing month of December, January, or February, deviates by more than 25% from the historical Average Daily Usage, the historical Average Dally Usage calculated for the previous year plus or minus 25% shall be substituted for the current dally usage In any such deviant month in calculating a new weighted Average Daily Usage to be used from March through the following February. For customers without an established historical Average Daily Usage, water consumption billing history for the preceding billing months of December through February, wastewater volume for each billing month through the following February shall be calculated at 98% of the actual water consumption for the month, subject to the following limitations: 1. For the billing months of March through November, the maximum wastewater volume for billing purposes shall be calculated based upon 98% of 6,500 gallons of water consumption. 2. For the billing months of December through February, the maximum wastewater volume for billing purposes shall be calculated based upon 98% of 30,000 gallons of water consumption. The monthly charge for apartments and mobile home parks shall be based on the maximum number of units rece~vlng wastewater service durlng the month. RATE Compost and Wood Mulch will be sold by volume on a cubic yardage basis, and are to be purchased in cubic yardage increments Quantities will not be sold in volumes less than one-half cubic yard. T PE OF C Compost and Wood Mulch may be purchased on Wednesdays or Saturdays, exclusive of legal holidays, at the Pecan Creek Water Reclamation Plant, located at 1100 Mayhlll Road, Denton, Texas, during the hours of 8:00 AM - 5:00 PM. All compost and wood mulch sold will be sold in bulk, and will not be bagged or otherwise packaged. No product deliveries will be made to any customer's site location at th~s time. W~0LESALE PURCHASES All compost or wood mulch purchased wholesale, for resale to the publlc, is to be identified as a City of Denton manufactured product. The wholesale purchaser must provide the City of Denton selling price information to the retail customer if it is requested. If a customer service characteristic requires facilIties and devices which are not normally and readily available at the location which the customer requests service, then the City shall provide the service subject to paragraph 2 of this schedule. (2) The total cost of all facilities required to meet the cus- tomer's special requirements which are Incurred by the City shall be subject to a special contract entered into between the Utility and the customer.
