AN OaOINANCE OF TI E CITY OF DENTON AmiNDING CHAPTER 28, SECTIONS 27
AND 28, OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS,
ADOPTING THE 1994 UNIFORM BUILDING CODE WITH CERTAIN AMENDMENTS,
DELETIONS, AND ADDITIONS THERETO, PROVIDING FORA SEVERABILITY CLAUSE
AND REPEALING CLAUSE, PROVIDING FOR A MAXIMUM PENALTY NOT TO EXCEED
TWO THOUSAND DOLLARS ($2,000 00) FOR EACH VIOLATION THEREOF, AND
PROVIDING FOR AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That Section 28-27 of the Code of Ordinances of the C~ty of Denton, Texas,
~s hereby amended to read as follows
Sec. 28-27. Adoption of building code.
The Uniform Bmldzng Code, 1994 Edmon, Volumes 1, 2, and 3, as pubhshed by the
Internattonal Conference of Bmldtng Officmls, a copy of wNch shall be filed ~n the office
of the c~ty secretary and avmlable for pubhc inspection, zs hereby adopted and demgnated
as the bmldlng code of the cry, the same as though that edition of such code were cop~ed
at length here~n, subject to the deletions and amendments enumerated ~n section 28-28
SECTION II That Section 28-28 of the Code of Ordinances of the C~ty of Denton, Texas,
~s hereby amended to read as follows

Except as specffied m subsection 106 2 of tNs sectzon, no braiding or structure
regulated by thru code shall be erected, constructed, enlarged, altered, repmred,
moved, ~mproved, removed, converted or demohshcd unless a permit for each
bmldtng or structure has first been obtmned from thc bmld~ng officxal A single
bmld~ng permit may be ~ssued for all bmld~ngs w~tNn an apartment complex A
separate electrical, plumbing, mechanical and one (1) driveway approach permit shall
not be reqmred when a bmld~ng permit for a new one- or two- family dwelhng of
four thousand five hundred ninety-rune (4,599) square feet or less m floor area or for

(3) Section 107 2, Permit Fees Section 107 2 is amended to read as follows
The fee for each permit except for apartment buildings shall be as set forth in Table
Nos 1-A and 1-B as set forth in section 28-28 (9) and (10) of the Code of
Ordinances For each multi-family building, the permit fee shall be determined by
multiplying the total floor area of each building, as defined in the Umform Building
Code by 11 4088 cents per square foot
(4) Section 107 3, Plan Review Fees Section 107 3 is amended to read as follows
For Group R, D~visaon 3, Occupancies, the plan review fee shall be ten (10) percent
of the building permit fee as shown m Table 1-B For all other occupancies, the
plan rewew fee shall be equal to fifty (50) percent of the building permit fee as
shown in Table 1-A
(5) Section 107 6, Fee Refunds The third paragraph of Section 107 6 as amended to
read as follows
The building official may authorize a refund of up to one hundred percent of the
plan rewew fee review fee paid, provided that the apphcation for a permit ~s
withdrawn or canceled before plan review is completed
(6) Section 108 5 4 1, Wall Insulation Inspection ~s added to read as follows
Apphcant shall permit Inspection of ~nsulat~on ~nstalled m exterior walls prior to
concealing ~nsulatlon
(7) Section 108 8, Relnspect~ons The fourth paragraph of section 108 8 is amended to
read as follows
To obtain a reinspeetlon, the appheant shall pay the remspect~on fee as set forth in
the fee schedule t~tled, "Other Inspections and Fees," secUon 28-28 (9)b, of the Code
of Ordinances, and then request an ~nspectlon in the manner prescribed by the
building official
(8) Section 109 1, Use and Occupancy Section 109 1 ~s amended to read as follows
Section 109 1, Use and Occupancy No person may occupy any building or
structure, and no change in use, tenancy or occupancy classification of a building or
portion thereof shall be made until the bmlding official has issued a certificate of
occupancy therefor as provided herein A new certificate of occupancy shall also be
required when a change of ownership of an operating bus~ness occurs The new
owner may continue to operate the bus~ness until the new certificate of occupancy

In regard to sprinkler systems, a temporary certificate of occupancy may be

at least two (2) sets of as-built drawings and hydraulic calculations are submitted
to and approved by the fire marshal
