1997-092A \Z-97-001 ORE) ORDINANCE NO. ~g--O?~ AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING A SPECIFIC USE PERMIT ALLOWING THE OPERATION OF A HALFWAY HOUSE/HOME FOR CARE OF ALCOHOLIC, NARCOTIC OR PSYCHIATRIC PATIENTS ON A 1.97 ACRE TRACT LOCATED ON THE SOUTH SIDE OF UNIVERSITY DRIVE, APPROXIMATELY SIX HUNDRED (600) FEET WEST OF CINDY LANE; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Mr. Richard Gibbons, on behalf of Starting Over, Inc, initiated a change in zoning for a 1.97 acre tract of land from the Agricultural (A) zoning district classification and use designation to the Light Industrial (LI) zoning district classification and use designation, and WHEREAS, on February 26, 1997, the Planning and Zoning Commission recommended approval of the change from the Agricultural (A) zoning district and use classification to the Light Industrial (LI) zoning district and use classification; and WHEREAS, the City Council finds that the usage desired by applicant can be accomplished by the adoption of the attached site plan and the issuance of an appropriate specific use permit without rezoning the sub]ect property; and WHEREAS, the City Council finds that the conditions set forth in Article III, Division 4, of Chapter 35 of the Code of Ordinances of the City of Denton, Texas, relating to the issuance of specific use permits have been met; NOW, THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That the issuance of a specific use permit authorizing the operation of a Halfway House/Home for care of alcoholic, narcotic or psychiatric patients on 1.97 acres of land located on the south side of University Drive, approximately slx hundred (600) feet west of Cindy Lane and more particularly described and incorporated herein as Exhibit A and conditioned by the site plan attached hereto and incorporated herein as Exhibit "B", is hereby approved. S~CTION II. That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION III. That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, a dally newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage.
