AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM THE AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION TO A SINGLE FAMILY 7 CONDITIONED (SF-7[C]) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION FOR 1140 ACRES LOCATED
APPROXIMATELY 1,500 FEET SOUTH OF ROBINSON ROAD ON THE
DENTON/CORINTH CITY LIMITS LINE; PROVIDING FOR A PENALTY IN THE
MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF, AND PROVIDING
FOR AN EFFECTIVE DATE
WHEREAS, the Lexington Group, on behalf of T~mberglen Co, owner of the subject
property, tmttated a change tn zoning for 11 40 acres (Exhtbtt 1) located approximately 1,500 feet
south of Robinson Road from the Agricultural (A) zomng dtstnct classification and use destgnatton
to the Single Family 7 (SF-7) zomng district classtficatton and use destgnat~on, and
WHEREAS, on March 12, 1997, the Planning and Zoning Commisston recommended
approval of a change in zomng from the Agricultural (A) zoning district classification and use
destgnatlon to a Single Famdy 7 Condttioned (SF-7[c]) zomng d~stnct classification and use
designation, and,
WHEREAS, the Ctty Counctl finds that thts change tn zonmg district wdl be m comphance
wtth the Denton Development Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the zomng dtstnct classification and use designation I 1 40 acres ~s
changed from the Agricultural (A) zonmg dtstnct classification and use destgnauon to a Single Famaly
7 Conditioned (SF-7[c]) zoning dtstnct classification and use designation under the comprehensive
zomng ordinance of the City of Denton, Texas, subject to the followmg condttton
that a ten (10) foot w~de bufferyard consisttng ora six (6) foot wooden fence, as well
as slx (6) canopy trees and ten (10) understory trees per every 100 hnear feet, or part
thereof, be constructed tn the reqmred setback along any Loop 288 frontage Said
buffe~yard ts to be tnstalled at the ttme bmldtng permtts are tssued for each lndivtdual
lot having frontage along Loop 288
SECTION II That the Ctty's offictal zomng map ~s amended to show the change in zomng
dtstrtct classtficatlon
SECTION III That any person vlolatmg any provlston of thts ordinance shall, upon
convlctton, be fined a sum not exceeding $2,000 00 Each day that a prowston ofthts ordinance ~s
violated shall constitute a separate and d~sttnct offense
SECTION IV That th~s or&nance shall become effecttve fourteen (14) days from the date
or,ts passage, and the Ctty Secretary ~s hereby &rected to cause the caption ofth~s ordtnance to be
pubhshed twine ~n the Denton Record-Chromcle, a dmly newspaper pubhshed ~n the C~ty of Denton,
Texas, w~th~n ten (10) days of the date of~ts passage
