AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING ORDINANCE 83-110
(PD-63) TO REDUCE THE REQUIRED FRONT YARD SETBACK FROM 25 FEET TO 24 3
FEET FOR LOT I, BLOCK 2, OF THE SNIDER ADDITION SECTION 2, PROVIDING A
SAVINGS CLAUSE, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF
$2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Ms Margaret McCarthy, on behalf of Umque International, owners of the
subject property, initiated an amendment to Ordinance 83-110 wtuch created Planned Development
63 (PD-63) and established the front yard setbacks for the uses permatted w~thm the subJeCt planned
development district, to reduce the front yard setback from 25 feet to 24 3 feet for Lot 1, Block 2,
of the Smder Addition Section 2, and
WHEREAS, on March 26, 1997, the Planning and Zoning Commission recommended
approval of an amendment to Orchnance 83-110 to reduce the front yard setback from 25 feet to 24 3
feet for Lot 1, Block 2, of the Smder Addition Section 2, and
WHEREAS, the City Council finds that this amendment to Ordinance 83-110 will be in
compliance with the Denton Development Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
S~ction I That Ordinance 83-110 (PD-63), attached hereto and incorporated herein by
reference, is amended to reduce the front yard setback for Lot 1, Block 2, of the Smder Addition
Section 2 from 25 feet to 24 3 feet
Section II That a copy of this ordinance shall be attached to ordinance No 83-110, showang
the amendment herein approved
Section III That the provisions of this ordinance, as they apply to Lot 1, Block 2, of the
Smder Addition Section 2, govern and control over any conflicting provisions of Ordinance No 83-
110, as they relate to the subjeCt property, but all the provisions of the Ordinance No 83-110 as they
apply to the remainder of PD-63 not herein amended shall continue m force and effect and shall apply
to the remtunder of PD-63
Section IV That any person vmlatmg any prov~sion oftbas ordinance shall, upon conviction,
be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall
constitute a separate and distinct offense
Section V That this ordinance shall become effective fourteen (14) days from the date of its
passage, and the C~ty Secretary ~s hereby d~rected to cause the captxon of th~s ordinance to be
pubhshed trace m the Denton Record-Chromcle, a daffy newspaper pubhshed m the City of Denton,
Texas, w~thm ten (10) days of the date of~ts passage
