AN ORDINANCE APPROVING A CERTIFICATION AGREEMENT BETWEEN THE CITY
OF DENTON AND THE TEXAS WORKFORCE COMMISSION, TO PROVIDE FUNDING
FOR SUPPORT AND PROVISION OF CHILD CARE TO ELIGIBLE CLIENTS, AUTHOR-
IZING THE MAYOR TO EXECUTE THE AGREEMENT, APPROVING THE EXPENDI-
TURE OF FUNDS THEREFOR, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the City desires to provide funding under an agreement with the Texas
Workforce Commission ("TWC") to support child care eligibility under Title VI of the Personal
Responslblhty and Work Opportumty Reconciliation Act of 1996 (the "Act") and provide such
social and/or other services for the benefit of eligible individuals from September 1, 1997 to
August 31, 1998, and
WHEREAS, by entenng into an agreement wath TWC subsequent to Tffie VI of the Act
to accept and expend funds for the purpose of providing these social and other services for child
care, additional reimbursements may be prowded pursuant to the attached Certification Agree-
ment wath TWC contract number UCN #03100C02 ("Agreement"), and
WHEREAS, the Agreement vath TWC vall provide the opportunity to obtain fimdmg of
appmxmaately $200,000, the federal share being $126,620 and the local matching share $73,380,
and the City Council deems at an the public interest to enter into this Agreement, NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS
~ That the City Councd hereby approves the Agreement attached hereto be-
tween the City of Denton and the TWC, to provide funding for child care services as described
above, and authorizes the Mayor, or an has absence, the Mayor Pro Tem, to execute smd Agree-
ment or ,any other documents necessary to the Agreement or the program
~ That the City Counml authorizes the expenditure of funds ~n the manner as
specified m the Agreement
~ That this ordinance shall become effective ammedmtely upon ~ts passage
and approval

The TEXAS WORKFORCE COMMISSION, herein referred to as TWC, and CITY OF
DENTON', hereinafter leferred to as the CerOfier, do hereby make and enter into fins contract
wtuch constitutes the entire agreement
1 CONTRACT AUTHORITY
TWC ts the lead agency tn Texas for the adrmmstraUon of child care funds avmlable under
Title VI of the Personal Responstblhty and Work Opportumty Reconcfliatton Act of 1996
(PRWORA) TWC has insuffictent appropnauons of state funds necessary to fully utthze
the federal cluld care funds available under the PRWORA The state's matcbang share for
costs of cluld care services is 36 69 percent EntlUes may contribute the state's share m
matcbang federal child care funds by expenditure certification
2 The Certtfier agrees
a To certify expendttures of approydmately $200,000 O0

September 1, 1997 through August 31, 1998
b To make its certification of expenditures to TWC wtthm the time frames spectfied
by TWC
c To keep, and make avmlable to TWC upon request, records adequate to show that
the total amount expended for sermces to eligible clients is eqmvalent to reported
certtfied expendttures and that the non-federal share qualifies as the non-federal
matching share Said records shall be retained for three years and 90 days a~er the
termination of the agreement
d That the only child care services covered under this agreement are those provided
in accordance with all applicable local, state and federal laws and regulations
e To provide TWC with certification information detadmg expenditures for care and
support in the format and w~thtn the time frames prescribed by TWC
f To provide TWC w~th data needed for federal reporting purposes upon request
3 TWC agrees to
a Inform the Cemfier of the tame frames and procedures for certification of
expenditures during the funding period
b Pay the Certifier the applicable federal matching share of the amount certified as
total expenditures for support and provision of child care to eligible clients
c Prepare all reports to the federal government on expenditures and sepaces in order
to obt~un federal matcbang funds
4 TWC and the Certifier mutually agree as follows
a Mutually agreed upon local operating plans and procedures will be used to
implement and carry out the terms and intent of this agreement relating to the time
period for the certification
b This agreement may be amended by the mutual agreement of both parties at any
time
c This agreement is contingent upon the avaflabd~ty of local, state, and federal funds
If funds are unavailable or reduced, written notice will be g~ven by either party of
termination, payment suspension, or funding reduction
d That if federal, state or local laws or other requirements are amended or judicially
interpreted so as to render continued fulfillment of this contract, on the part of
either party, substantially unreasonable or impossible and if the parties should be
unable to agree upon any amendment which would therefore be needed to enable
the substantial continuation of the services contemplated here~n, the pames shall be
d~scharged from any further obligations created under the terms of this contract,
except for the equitable settlement of the respective accrued interests or
obhgations incurred up to the date of termination

e Ttus agreement may be terminated by either party, for any reason, upon written
notification to the other party at least 90 days m advance of such ternunation
Notlung m this paragraph shall be construed to prolubit ~mmediate cancellation
pursuant to items (c) and (d) above

1 Referral of clients
Clients to be funded under this program can be self referred or referred by anyone

2 Ehglbdlty
The Contractor wall determine eligibility using the most current income ehglblhty
code card Specific criteria applicable to this agreement are
a Clients must be children who live within the City of Denton, in need of
care, and are receiving services at any of the following
* After School Action Site Program
* Denton IndepEndent School District - Teen Parent Program
(Children not being prod for by the CCMS or DISD PEP funds)
* MLK Fangs Kids Summer Day Kamp
* Owsley Summer Playground Program
b Children must meet all other eligibility requirements for PRWORA
funding
c An acknowledgement of time-limited funding will be included in the
paperwork that parents sign dunng the intake process
3 Delivery of Chdd Care
Child Care vail be prodded at the above sites or at sites previously approved
by the City of Denton
4 Parent Fees
Parent fees vall be assessed in accordance vath standard TWC policies In
general, a family vath one cluld in care vail have a parent fee of 9% of the gross
monthly income, while a fanuly vath two or more duldren in care will have a
parent fee of 11% of the gross monthly income
5 Attendance
Each entity will m/untam documentation of each cluld's attendance in day care
Ttus information vail be provaded to the City of Denton on a monthly basis by the
cbald care proxaders Standard TWC attendance policies vall apply to children
served under this agreement
6 Funds Management
a Payment for child care provided to these children will be made by
the City of Denton
b Reimbursement of the Federal share (63 31%) of the amount spent by
the City of Denton for child care will be managed by the TWC contract
manager
c Prior to billing, all sites will be licensed by either the Chdd Care
Licensing Dlwslon of the Department of Protective and Regulatory
Services or the Health Department, whichever is applicable
d Chdd care providers vall bdl the City of Denton each month for ctuld
care provided to eligible children using Form 2016
e The City of Denton will pay the providers for all eligible cl~ld care
f On a regular basis, the Cay of Denton will review the form 2016% for
accuracy, complete and attach a form 4116 and marl it all to the TWC
contract manager
g The TWC contract manager will monitor the billing for accuracy and
funds avadabdity and send the documents to State Office for payment
h The final billing must be completed by the City of Denton and in the
hands of the Contract Manager by no later than September 16, 1999
