AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN INTERLOCAL
AGREEMENT WITH THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS
(NCTCOG) RELATING TO PARTICIPATION IN VARIOUS CITY OF DENTON CONTRACTS
WHICH PROVIDE FOR THE PURCHASE OF VARIOUS GOODS AND SERVICES, AND
DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SF_,CXiON~ That the Mayor is hereby authorized to execute an Interlocal Agreement w~th
the North Central Texas Council of Governments (NCTCOG) relating to participation in various
City of Danton contracts which provide for the purchase of various goods and services, a copy of
such agreement is attached hereto and incorporated by reference
SEC/ION2L That this ordinance shall become effective immediately upon its passage and
approval

RECOMMENDATION: We recommend the attached Interlocal Agreement between North Central Texas
Council of Governments and the C~ty of Denton be approved
~: Tbas mterlocal agreement is intended to allow the City of Denton to participate in cooperative
purchasing agreements v~th NCTCOG for miscellaneous materials and supplies The primary acquisition is
Ielre Department/EMS supplies and/or small equipment items

~f Acquisitions utilizing this lnterloeal agreement will come from budget funds Any

a Regional Planning Council of the State of Texas,
Pursuant to the authority granted by the Texas Interlocal Cooperation Act, Article 4413 (32c)
V A T S, prowd~ng for cooperation between local governments , section 791 025 (b), Local
Government Code, and Chapter 271, Subchapter F, Local Government Code, which authonzes
local government participation ~n cooperative purchasing programs operated by regional councils,
the part~ee hereto, In consideration of the premises and mutual promises contained here~n, agree
as follows
CT~"Z Or ])~e~'Ot~ , hereinafter referred to as PURCHASER, appoints the NCTCOG,
hereinafter referred to as COUNCIL, as ~ts purchasing agent for the purchase of selected goods
and products through the COUNCIL'S Cooperative Purchasing Program PURCHASER agrees
that the COUNCIL shall serve as the purchasing agent for sa~d ~tems, and agrees that the b~d
process shall be conducted by the COUNCIL according to statutory b,ddmg requirements
PURCHASER agrees that all b~d spec#~cat~ons for sa~d ;tems shall be as determined by
the COUNCIL
PURCHASER shall be responsible for payment d~rectly to the vendor under each contract
entered ~nto pursuant to the cooperative purchasing program, and shall be responsible for the
vendor's comphance w~th all cond;t~ons of dehvery and quahty of the pumhased ~tems
cz~t'~ o~' ])~¢a'~ot~ ~s hereby designated as the official representabve to act
for the PURCHASER in all matters relating to the program, including the designation of specific
contracts in which the PURCHASER desires to parbclpate

to the agreement
