adjusted by multiplying the applmcable fee times a fraction

the estimated cost of such installation, or s~milar work, plus an

Ail servzce shall be offered from avazlable facllltzes If a
customer service characteristic requzres facilities and devices
which are not normally and readily available at the location at
whzch the customer requests service, then the City shall provide
the service subject to paragraph 2 of this schedule
The total cost of all facilities necessary to meet the customer's
special requirements which are incurred by the C~ty shall be
subject to a special contract entered into between the Czty and the
customer This contract shall be s~gned by both parties prior to
the City providing service to the customer

tence, clause, phrase or word in this ordinance, or application
thereof to any person or cmrcumstances is held invalid by any court
of competent jurisdiction, such holding shall not affect the valid-
lty of the remaining portions of this ordinance, and the City Coun-
cil of the City of Denton, Texas, hereby declares it would have
enacted such remaining portions despite any such mnvalmdzty
SECTION III That the Schedule of Rates herein adopted shall
be effectmve, charged and applied to all water consumption
occurring on or after October 1, 1997, and a copy of said rates
shall be maintained on file ~n the Office of the City Secretary

THE WHOLESALE RAW WATER SERVICE TO UPPER TRINITY REGIONAL WATER
DISTRICT SCHEDULE (WRW), PROVIDING FOR A REFUND, PROVIDING FOR A
SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, on the 2"d day of September, 1997, the City Council passed and approved
Ordinance No 97-237 adopting the rate schedules respecting water service for the City of
Denton Included within said ordinance was Schedule WRW pertalmng to Wholesale Raw
Water Service To Upper Trinity Regional Water District The applicable raw water rate stated in
the ordinance was $0 3679/1000 gallons However, City staff discovered that an inadvertent
error occurred in their calculation of said rate, and that the correct raw water rate should have
been expressed as $0 3602/1000 gallons, and
WHEREAS, the City Council desires to correct the appheable raw water rate pertaining
to Schedule WRW, effective October l, 1997, the effective date of the Schedule WRW
heretofore adopted by Ordinance, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS

No 97-237 and in Chapter 26 of the Code of Or&nanees, is amended to add the corrected

and supercedes the Schedule WRW heretofore adopted in Ordinance No 97-237
~ That the Assistant City Manager/Utflihes is hereby authorized to expend
funds to issue a refund to the Upper Trinity Regional Water District, in the event and to the
extent that the City has collected greater than $0 3602/1000 gallons from Upper Tnnlty Regional
Water District from and after October 1,1997 pursuant to Schedule WRW
~ That if any section, subsection, paragraph, sentence, clause, phrase or
word in this ordinance, or application thereof to any person or circumstances is held invalid by
any court of competent jurisdiction, such holding shall not affect the validity of the remaining

AN ORDINANCE AMENDING THE SCHEDULE OF WATER RATES CONTAINED IN
ORDINANCE NO 97-237 FOR WATER SERVICE WHICH ADDS THE WHOLESALE
TREATED WATER SERVICE TO UPPER TRINITY REGIONAL WATER DISTRICT
SCHEDULE (WW2), PROVIDING FOR A SEVERABILITY CLAUSE, AND PROVIDING
FOR AN EFFECTIVE DATE
WHEREAS, on the 4th day of February, 1997, the C~ty Councd passed and approved
Ordinance No 97-035, and pursuant to said ordinance, the C~ty Manager executed an
"Addendum To Contract Between C~ty of Denton and Upper Tnmty Regmnal Water D~strmt for
Water Treatment and Transmission Servmes" (hereinafter the "Addendum") The Addendum
provided for the dehvery of the City of Denton's treated water to the Upper Tnmty Regional
Water District for resale to the City of Sanger, which Addendum also established the rate
methodology to be utlhzed by the City m deslgmng the wholesale water rate pertaining thereto,
and
WHEREAS, sales of wholesale water under such Addendum are projected to begin in
late Aprd, 1998, and accordingly the City staff has demgned a new water rate, entitled the
"Wholesale Treated Water Service To Upper Tnmty Regmnal Water District" rate, which rate is
set forth m Schedule WW2 attached hereto, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS

of the Code of Ordinances, Is amended to add the Wholesale Treated Water Service To Upper
Tnmty Regional Water District Schedule (WW2), which schedule is attached hereto and is
incorporated herewtth by reference
~ That If any section, subsection, paragraph, sentence, clause, phrase or
word ~n this ordinance, or apphcatlon thereof to any person or c~rcumstances is held mnvahd by
any court of competent jurisdiction, such holding shall not affect the vahd~ty of the remaimng
portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it
would have enacted such remaining portions despite any such invalidity

FIRE HYDRANT METER USE AGREEMENT
This Agreement is made between (hereinafter called the
"CONTRACTOR") and the City of Denton a mnmclpal corporation (hereinafter called the "C~ty")
In consideration of the mutual covenants contained m thru Agreement and other valuable consldera~on the
receipt of which is acknowledged, the part,es agree as follows
On the terms and condltmus set out m this Agreement or as otherwme provided here, the City
agrees to let the CONTRACTOR use the following fire hydrant meter number
and the hackflow prevention assembly
2 The CONTRACTOR shall use the Equipment only tn the manner for which It was designed and
~ntended and so as to subject it only to ordinary wear and tear The CONTRACTOR shall not
penmt any Equipment to be used m v~olatmn of any federal, state, or municipal laws, ordinances,
rules or regalatmns, or contrary to the provisions of this Agreement The CONTRACTOR shall
mden~mffy and hold the City harmless from any and all frees, forfelt~ras, damages or penalties
resnltmg from violat~ous by the CONTRACTOR
3 The term of this Agreement shall commence on , 19 , and ending when the
equipment is returned m good condition excepting normal wear and tear
4 The CONTRACTOR agrees to pay to the City on the first of each month starting on __ of

due all taxes, fees, assessments and other govemmantal charges or levies unposed during the term
of tlus Agreement w~th respect to any of the Equipment, provided that the tax, fee, assessment,
charge or levy need not be prod if, and so long as, its vahdrty shall currently be contested by
appropriate proceedings In case of the CONTRACTOR'S failure so to do, the City may recover
the property and all cost of such recovery shall be xmmediately be due and payable from the
CONTRACTOR
6 Return of Equipment The CONTRACTOR shall at the end of tins Agreement or at the earlier
expiration or other termination of flus Agreement with respect to the fire hydrant meter and
backflow prevention assembly, deliver the equipment m good order and repair, reasonable wear
and tear excepted, free and clear of all liens, charges and encumbrances of any nature excepting
only those granted by or arising through the City
7 Indermuficat~on Except as otherwise provided m tins Agreement, the CONTRACTOR shall
release fully and hold the City, its agents and employees harmless and will mdemmfy them from
all habllmes, including costs and legal fees, ff any, including clauns for damages on account of
loss or damage to the property of, members of the public, the agents, servants employees,
hcansees, tenants, lessees and patrons of the City, m any manner aCfflbutable to or arising out of
the ownership, operation or maintenance of the Equipment, regardless of whether caused m whole
or m part by the negligence of the City, provided, however, that this provision shall not apply to
hahiht~as proxunately caused by acts of the City, which coust~tute willful and wanton negligence
or criminal acts
8 Loss of Equipment If any of the Equipment is lost, stolen, or willfully or accidentally destroyed,
the CONTRACTOR will notify the City unmethately m writing and use all reasonable endeavors
at the CONTRACTOR'S own expense to recover the Equipment
9 The CONTRACTOR has this day deposited with the City of Denton the sum of Eight Hundred
Dollars ($800 00), the receipt whereof is hereby acknowledged by the City, as security for the
payment of use of the fire hydrant meter and backflow prevention assembly, and for the faithful
performance by it of all the other obhganon hereunder, and for the payment of any and all sums of
money for which tt may be, or become, liable hereunder Said sum of $ Dollars or so
much thereof as shall not be applied for the purposes aforesaid, shall be returned to the
CONTRACTOR, its successors or assigns, at the expiration of this Agreement, and upon the
surrender of the frre hydrant meter and backflow prevention assembly, provided all the terms,
coodltions, covenants and agreements herem mentioned have been performed by the said
CONTRACTOR, its successors and assigns
10 The CONTRACTOR shall on or before the 3'd of each month during the term of this Agreement
bring the fire hydrant meter m for reading and physical inspection by the City If the
CONTRACTOR falls to do so it will agree and accept to pay the billing from the City that is
eqmvalant to the use of 100,000 gallons of water for that month If within the tune to pay the
bdlmg the CONTRACTOR bring the fire hydrant meter m for reading the CONTRACTOR will
be billed for the actual amount of water used The security deposit may be used against any
billing that Is due and outstanding at the tune of the termination of this Agreement
11 Default (a) If, dmmg the continuance of this Agreement one or more of the following events
("Evants of Default") shall occur
(x) default shall be made m the payment of any payment to be made by the CONTRACOTR
and tho default shall continue for 30 days after written notice from the City to the
CONTRACTOR of the default and demand that it be remedied,
(il) Default shall be made m the observance of performance of any other of the covenants,
eondltmns and agreements on the part of the CONTRACTOR contained here and the
default shall continue for 30 days after written notice from the City to the
CONTRACTOR, specifying the default and damaodmg that it be remedied, then m any
such case the Authonty, at m option, may exercise any or all of the following rights
(m) Proceed by appropnate court acUon, either at law or m equity, to enfome performance by
the CONTRACTOR of this Agreement or to recover damages for breach, or
(Iv) By notice m writing to the CONTRACTOR, terminate tlus Agreement, at which tune all
right of the CONTRACTOR to the use of the Equipment shall terminate as though this
Agreement had never been made, but the CONTRACTOR shall remain liable as provided
below, and the City may then by its agents enter upon the premises of the
CONTRACTOR or other prenuses where any of the Equipment may be located and take
possession of all or any of the Equipment and possess the Equipment free from any right
of the CONTRACTOR, or its successors or assigns, to use the Eqmpment for any
purpose whatever, but the City shall, nevertheless, have a right to recover from the
CONTRACTOR all amounts wfuch under the term of this Equipment Agreement may be
then due or which may have accrued to the date of the termination, or
(v) Pay any expense or charges which the CONTRACTOR is obhgated to pay pursuant to
th~s Agreement which the CONTRACTOR has failed timely to pay These amounts shall
then be munethately due and payable by the CONTRACTOR to the City
(b) The remedies m tlus Agreement provided m favor of the City shall not be deemed
exclusive, but shall be m adthtion to all other reme&es m its favor exlstmg at law or m
equity The CONTRACTOR waives any mandateD, reqmremants of law, now or
subsequently m effect, which nught 1rout or modify any of the remedies here, to the
extent that the waiver is pemutted by law
(c) The failure or delay of the City to exercise the nghts granted it here upon any occurrence
of any of the events set out her shall not constitute a waiver of any right upon the
contmuanon or recurrence of those or smular events
(d) The CONTRACTOR shall promptly advise the C~ty of all correspondence, notices,
accident reports and other documents, received by the Corporation and assert'mi any
claun or demand revolving or relating to title to, or liens upon, the Equipment and will

the term of this Agreement
11 Warranty Dlsclanner. THE CITY, NOT BEING THE MANUFACTURER OF THE
EQUIPMENT NOR THE MANUFACTURER'S AGENT, MAKES NO
EXPRESSED OR IMPLIED WARRANTY OF ANY KIND WHATSOEVER
WITH RESPECT TO THE EQUIPMENT, THE AUTHORITY DISCLAIMS ALL
WARRANTIES, INCLUDING BUT NOT LIMITED TO THE
MERCHANTABILITY OF THE EQUIPMENT OR ITS FITNESS FOR ANY
PARTICULAR PURPOSE, THE DESIGN OR CONDITION OF THE
EQUIPMENT, THE WORKMANSHIP IN THE EQUIPMENT, COMPLIANCE
OF THE EQUIPMENT WITH THE RQUIREMENTS OF ANY LAW, RULE,
SPECIFICATION OR CONTRACT PERTAINING TO THE EQUIPMENT
PATENT INFRINGEMENT, LATENT DEFECTS, AND TITLE The City and the
CONTRACTOR shall cooperate for the purpose of obtammg the full benefit of any
manufacturers' warranties with respect to the Equipment
12 Dlsclarmer of Liability Neither the Mayor nor any mthvldual Council member of the
City Council or its employees or agents shall be personally liable to the CONTRACTOR
m any way by reason or any clause of tins Agreement
13 Govemmg Law This Agreement shall be construed m according with and be governed
by the laws of the State of Texas
14 Notices Any notice required or permttted by this Agreement shall be m writing and may
be either delivered m person or delivered by depositing m the Umted States Mall, postage

User shall place a deposit each time a City's hydrant meter(s) is

Monthly volume shall be computed by subtracting the beginning meter
reading from the ending meter reading divided by 1,000, and
multiplied times the volume charge, upon the monthly return of the-
meter to the Water Department for reading Per the "Flre Hydrant
Meter Use Agreement", failure by the customer to return the meter
to water utlltles by the 3rd of each month for reading, results in
acceptance by the customer to pay a monthly billing equal to
100,000 gallons of water usage for the month

charges w~ll be adjusted up ~f ending the f~scal year, the actual
peak demand requlred during the fiscal year, as establlshed by the
highest rate of flow controller setting for any one day during the
~ fiscal year, ~s greater than the peak demand subscribed and billed
during the fiscal year. If the actual peak demand has a variance

BILL PAYMENT DELINQUENCY
Denton shall render bills on the tenth (10th) day of each month

delinquent if not paid within 20 calendar days of the date a bill
for service is rendered. There shall be a ten percent per annum
interest charge on the amount due, from the date when due until
paid, if not paid wmthln 20 calendar days of the date a bill for

FEES FOR INSTALLATION NOT LISTED
For installation of a tap, loop or meter for which a fee is not
specified, the requestor shall pay in advance a deposit based upon
the estimated cost of such installation, or similar work, plus an
administration charge of 20%. Upon completion of the installation,
the applicant shall be billed at actual cost, as determined by the
Utlllty Department, plus a 20% administrative charge.
The installation charges may be waived by the utility department for
a request to install taps exclusively dedicated to fire sprinkler
systems.

SPECIAL FACILITIES RIDER

All service shall be offered from available facilities If a
customer service characteristic requires facilities and devices
which are not normally and readily available at the location at
which the customer requests service, then the City shall provide
the service sub3ect to paragraph 2 of this schedule
The total cost of all facilities necessary to meet the customer's
special requirements which are incurred by the City shall be
sub3ect to a special contract entered into between the City and the
customer This contract shall be signed by both parties prior to
the City providing service to the customer

thereof to any person or circumstances is held invalid by any court
of competent jurisdiction, such holding shall not affect the valid-
lty of the remaining portions of this ordinance, and the City Coun-
cil of the City of Denton, Texas, hereby declares it would have
enacted such remaining portions despite any such invalidity
