1997-240AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING ARTICLE V "PUBLIC
AND SEMIPUBLIC SWIMMING POOLS" OF THE CODE OF ORDINANCES OF THE CITY
OF DENTON BY AMENDING SECTION 14-112 "HEALTH OFFICER INSPECTIONS" AND
SECTION 14-113 "PERMITS TO OPERATE," PROVIDING A PENALTY NOT TO EXCEED
$2,000, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE,
PROVIDIIqG FOR PUBLICATION, AND PROVIDING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That Section 14-112 "Health Officer Inspectaons" of the Code of Ordinances of
the City of Denton, Texas is hereby amended to read as follows
See. 14-112 Health Ogicer Inspections.
The health officer is authorized to conduct such inspections as he deems necessary to ensure
comphance vath
(a) all provmions oftbas article and oftha Denton City Code relating to Swnnnnng Pools,
(b) all provmlons of ArUde VI "Svammmg Pool Code" of Chapter 28 of the Code of Orthnances
of the City of Denton, Texas that relate to the maintenance and operaUon of pools,
(c) all prowmons of Texas AdnnmstraUve Code Title 25 "Health Senates" Part 1 Texas
Department of Health Chapter 337 (Design Standards for Public Svammmg Pool
Constru~on), as amanded, that relate to the maintenance and operation of pools,
(d) all prov~mons of Health and Safety Code Title 5 Samtataon and Environmental Quahty Subutle
A Samtatton Chapter 341 0VImnnum Standards of Samtatlon and Health Protection), as
amended,
(e) all provmlons of Health and Safety Code, Title 9 Sagety Subtitle A Public Safe~y Chapter 757
(Pool Yard Enclosures), as amended
and shall have the right of entry at any reasonable hour to the public or sen~pubhc pool for th~s
purpose
If same be necessary, Chapters 337, 341 and 757 referenced above are hereby adopted and
mcorporatad hereto as ff copied in full hereto In case of conthct between paragraphs (a) - (e) of flus
section, the more restrictive regulation shall apply
SECTION II That Section 14.113 "Pernuts To Operate" of the Code of Ordinances of the
City of Denton, Texas, is hereby amended by adding subsecttons (c) and (d) to read as follows
Sec. 14-113. Permits to Operate
[See Denton City Code for (a) and (h)]
(c) An annual fee is hereby established for the inspection of swimming pools m the amount or
$190 00 for each pool
(d) A~fee is hereby estabhshed for the certrficat~on course for a swmm~ng pool operator in the
amount of $35 00 per student
SECTION III That any person v~olatmg any provision of tbas ordinance shall, upon
conv~ction, be fined a sum not excecdmg $2,000 00 Each day that a prowsion of th~s orchnance is
v~olated shall constitute a separate and obstruct offense
~ That ffany section, subsection, paragraph, sentence, clause, phrase or word m
tl~s ordinate, or apphcat~on thereof to any person or c~rcumstance is held invalid by any court of
competent junschction, such holding shall not affect the vah&ty of the remaining portions of tl~s
ordinance, and the City Counctl of the City of Denton, Texas hereby declares it would have enacted
such remaining portions despite any such mvahday
SECTION V That save and except as amended hereby, all the scions, sentences, and clauses
of Article V, sections 14-112 and 14-113 of the Code of Orchnances of the City of Denton, Texas shall
remain m ~ force and effect
SECTION VI, That tbas ordinance shall become effective fourteen (14) days from the date of
its passage, and the City Secretary is hereby &rected to cause the caption of th~s ordinance to be
pubhshed twice m the Denton Record-Chromcle, the official newspaper of the City of Denton, Texas,
