1997-256A \~o~? ~ NOTE: Amended by Ordinance No 98-141 ORDINANCE NO ~ AN ORDINANCE ADOPTING THE BUDGET FOR THE CITY OF DENTON, TEXAS, FOR THE FISCAL YEAR BEGINNING ON OCTOBER 1, 1997, AND ENDING ON SEPTEM- BER 30, 1998, AND DECLARING AN EFFECTIVE DATE WHEREAS, notice of a public hearing on the budget for the City of Denton, Texas, for the fiscal year 1997-98 was heretofore pub- llshed at least fifteen (15) days in advance of said public hear- lng, and W~EREAS, a public hearing on the said budget was duly held on August 12, 1997, and all interested persons were 91yen an opportu- nity to be heard for or against any item thereof, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SI_S_S_S_S_S_S_S_S~~ That the budget for the City of Denton, Texas for the fiscal year beginning on October 1, 1997, and endln9 on September 30, 1998 prepared by the City Manager and filed with the City Secretary, as amended by the City Council, is hereby approved and adopted, a copy of which budget is attached hereto and incorporated by reference herein ~ That the City Council hereby appropriates from available resources to the following funds General Fund $ 41,344,295 Electric Fund hereby authorized to transfer the amounts of money for employee benefit and salary adjustments as contained in the 1997-98 budget to the various departments ~ That the City Manager shall cause copies was adopted, the Denton Independent School Dtstnct ("DISD") requested the Ctty of Denton to develop a cooperattve after school program to meet the needs of students at Calhoun, Stnckland, and McMath Mtddle Schools, and WHEREAS, there ts a need for after school programming for pre-teen and teen children extstlng tn the City of Denton, as expressed by parents, to provtde these educattonal opportum- ttes in a safe and supervised envtronment, and WHEREAS, the Ctty of Denton, through tts Parks and Recreatton Department, has worked eooperattvely with DISD for many years to provtde for the needs of children in Denton, and WHEREAS, the C~ty's Parks and RecreaUon Department and DISD are able to provide a recreattonal edueattonal program at Calhoun, Stnckland, and McMath Mtddle Schools, whtch includes transportation of parttctpants on field trips, and WHEREAS, the City Manager advised the Ctty Council that such revenue and expendi- ture was not antic~pated prior to the adopuon of the 1997-98 budget and could not have been tn- cluded tn the original budget, and WHEREAS, there was a movement of stxth grade students tnto the mtddle school pro- gram begmnmg tn August, 1998, and after school programs for thts age group have been recog- razed as a critical need on both a national and local level, and WHEREAS, Section 8 08 of the Charter of the Ctty of Denton and Sectton 102 009 of the Texas Local Government Code provide that a guvermng body may authorize an emergency ex- penditure as an amendment to the original budget only tn a case of grave pubhc necessity to meet an unusual and unforeseen condmon that could not have been mcluded tn the original budget through the use of reasonably dthgent thought and attention, and WHEREAS, the C~ty Council finds that the failure to expend the funds d~scussed above will create a grave pubhc necessity and reqtures the 1997-98 budget to be amended tn the amount of twenty-one thousand five hundred rune dollars ($21,509 00), NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS ~ That the Ctty Council hereby adopts the findings listed above ~ That the 1997-98 Recreation Fund Revenue Budget of the City of Denton is hereby amended tn the amount of twenty-one thousand five hundred nine dollars ($21,509 00) to be collected from the monthly fees of registered participants at Calhoun, Stnckland, and McMath Middle Schools to provide a recreational educational program at Calhoun, Stnckland, and McMath Middle Schools tn cooperation with the Denton Independent School District, and allocating such funds to the Children's Program Revenue account tn the Recreation Fund SECTION III That the 1997-98 Recreation Fund Budget of the City of Denton is hereby further amended by expending sums fi.om the unappropriated
