1997-297AN ORDINANCE AMENDING SECTION 8-162 "ACCESS CHANNELS" OF CHAPTER 8
OF THE CODE OF ORDINANCES OF THE CITY OF DENTON TO ALLOW PUBLIC AC-
CESS CHANNEL RULES TO BE DEVELOPED BY THE CABLE OPERATOR AND TO
DELEGATE TO THE CABLE OPERATOR THE AUTHORITY TO ADMINISTER AND
OVERSEE THESE PUBLIC ACCESS RULES, PROVIDING A REPEALER CLAUSE, AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, under Sectton XXII of the Cable Television Franchise Agreement between
the Caty and Marcus Cable Assocmtes, L L P ("Marcus"), the C~ty and Marcus, or any succes-
save cable operator or grantee must cooperatively estabhsh mles for the use of the pubhc access
channel, and
WHEREAS, the Caty Council deems ~t m the pubhc interest for Marcus to estabhsh pub-
llc access rules and to anthonze the delegation to the cable operator of the admmlstrataon and
operation of the cable TV pubhc access channel, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS
SECTION I That Sectaon 8-162 "Access Channels" of Chapter 8 of the Code of Ordi-
nances of the Caty of Denton ~s hereby amended by adding a new subsectmn (e), winch shall read
as follows
Sec. 8-162. Access Channels.
(e) The Ctty Council, in cooperation with the cable operator or grantee, shall develop
pubhc access channel rules for the use of the pubhc access channel The City Council may, by
resolutxon, delegate to the cable operator the admunstratxon and oversxght of the operatmn of the
cable TV public access channel, and delegate to the cable operator the authority to develop ad-
ministrative and other procedures for the operation of the pubhc access channel under such con-
dltxons as the City Council may establish m that resolutxon The C~ty Council shall have the right
by resolution to repeal or limit the power of the cable operator to admunster and oversee the op-
eration of the public access channel or to repeal or revise any adm~mstrat~ve or other procedures
the cable operator establishes
SECTION II That all ordxnances or parts of ordinances an force when the provxslons of
tins ordinance become effective, winch are ancons~stent or in conflmt w~th the terms or provi-
sions contmned m th~s ordinance, are hereby repealed to the extent of any such conflmt only
The non~confhct~ng sectxons, sentences, paragraphs, and phrases shall remaxn m full force and
effect
SECTION III That tins ordinance shall become effectxve ammedmtely upon ats passage
and approval
