1997-312C~\WPDOC~\ORD\SPEED.ORD AN ORDINANCE DESIGNATING AND ESTABLISHING SPEED LIMITS FOR THE FOLLOWING HIGHWAYS WITHIN THE CITY OF DENTON; PROVIDING THAT THIS ORDINANCE SHALL NOT EFFECT SCHOOL ZONE ORDINANCES REGULATING THE SPEED OF VEHICLES DURING DESIGNATED HOURS; PROVIDING FOR A PENALTY OF A FINE NOT TO 'EXCEED TWO HUNDRED DOLLARS ($200.00); PROVIDING FOR A SEVER- ABILITY CLAUSE; PROVIDING FOR A REPEALING CLAUSE; AND DECLARING AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: ~ Based upon an engineering and traffic investigation as authorized by the provisions of Section 545.356, Texas Transportation Code, the following prima facie reasonable and prudent speed limits are hereby fixed for vehicles traveling upon the following named highways, or parts thereof: Hi~hwa~ Extent ~ 1. Ryan Road From its intersection with FM 35 MPH 2181 west to its intersection with the city limits of Denton. 2. Mayhill From its intersection with 35 MPH Road US 380 to 1ts intersection with 1-35 E. ~ The regulation of the speed of a vehicle under this ordinance does not apply to: (1) an authorized emergency vehicle responding to a call; (2) a police patrol; or (3) a physician or an ambulance responding to an emergency call. ~ That if any port,on of any of these highways are regulated by school zone ordinances, then the maximum prima facle speed .limit established by the school zone ordinance shall apply during,the house designated by the school zone ordinance. ~ An individual adjudged guilty of violating any provisions of this ordinance, when signs are erected giving not~ce thereof, shall be guilty of a misdemeanor, and punished by a fine not to exceed Two Hundred Dollars ($200 00). ~ Ail ordinances or parts of ordinances in force when the provisions of this ordinance become effective which are inconsis- tent or in conflict with the terms or provisions contained ~n this ordinance are hereby repealed to the extent of the conflict, except for school zone ordinances which limit the speed of vehicles during designated time periods. ~ That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held ~nvalld by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares bt would have enacted such remaining portions despite any such invalidity. ~ That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton-Record Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage. ~/~a ~~f PASSED AND APPROVED this the y of , 1997.
