AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING ORDINANCE NOS 92-
014 AND 93-051 TO PROVIDE FOR A CHANGE IN THE DETAILED PLAN FOR PLANNED
DEVELOPMENT (PD) NO 144 ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION, AND IMPOSING A CONDITION FOR 1 63 ACRES OF LAND LOCATED ON
THE EAST SIDE OF BONNIE BRAE, APPROXIMATELY 800 FEET SOUTH OF WEST
UNIVERSITY DRIVE, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF
$2,000 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Gossett Construction, Inc, on behalf of Dr Marflyn Janke, has applied for an
amendment to the detmled plan set forth in Ordinance 93-051 for 1 63 acres of land in planned
development (PD) No 144 zomng district classification and use designation and agrees to the
imposition of a condition for the district, and
WHEREAS, on November 5, 1997, the Planmng and Zomng Connmsslon, after a public
hearing, recommended approval of the requested changes, and
WHEREAS, the City Council finds that the amended det~uled plan vall be m compliance vath
the Denton Development Plan, NOW THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That Ordinance Nos 92-014 and 93-051, providing approval of a planned
development district for 1 63 acres of land as described therein, is hereby amended by approval of a
revised detailed plan for planned development district No 144, as described m said det~uled plan
attached hereto as Exhibit "A", incorporated hereto by reference The property thereto described shall
be constructed, used, and mamtmned m accordance with the approved detailed plan, and shall be
subject to the following additional condition
1 The budding identified as No 2 on the detailed plan shall be guttered to allow for
stormwater runoff in the same manner as the building identified as No 1 on the
detoaled plan
SECTION II That the provisions of this ordinance as they apply to the 1 63 acres shown in
the detailed plan herein approved, shall govern and control over any coralictlng prowslon of
Ordinance Nos 92-014 and 93-051, but all the prov~sions of Ordinance Nos 92-014 and 93-051 as
they apply to that remaimng portion of the district not herein amended, shall continue in force and
effect and shall apply to the remainder of the district
SECTION III That a copy of this ordinance shall be attached to Ordinance Nos 92-014 and
93-051, showing the amendment herein approved
SECTION IV That any person violating any provision of tins ordinance shall, upon
conviction, be fined a sum not exceeding $2,000 00 Each day that a provision ofth~s ordinance is
v~olated shall constitute a separate and distract offense
S~ECTION V That this ordinance shall become effective fourteen (14) days from the date
of its passage, and the C~ty Secretary is hereby directed to cause the caption of this ordinance to be
pubhshed twice m the Denton Record Chromele, the official newspaper of the City of Denton, Texas,
w~thin ten (10) days of the date of its passage
