AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM THE SINGLE FAMILY RESIDENTIAL (SF-7) ZONING DISTRICT CLASSIFI-
CATION AND USE DESIGNATION TO THE OFFICE CONDITIONED (O[c]) ZONING
DISTRICT CL~SSIFICATION~ND USE DESIGNATION FOR 0 155 ACRES OF L~ND
LOCATED AT 1413 EAST McKINNEY STREET, PROVIDING FOR A PENALTY IN
THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AIqD
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Barbara Russell has applied for a change mn zoning
for 0 155 acres of land from the Single Family Residential (SF-7)
zoning district classification and use designation to the Office
conditioned (O[c]) zoning district classification and use designa-
tion, and
WHEREAS, on January 10, 1996, the Planning and Zoning Commis-
sion recommended approval of the requested change in zoning, and
WHEREAS, the City Council finds that the change in zoning will
be in compliance with the Denton Development Plan, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the zoning dlstrmct classification and use
designation of the 0 155 acres of land described as in Exhibit 1,
attached hereto and incorporated into this ordinance by reference,
is changed from the Single Family Residential (SF-7) zoning
district classification and use deslgnatmon to the Office condi-
tioned (O[c]) zoning district classification and use designation
under the comprehensive zoning ordinance of the City of Denton,
Texas, subject to the following addmtlonal conditions
i Use of any structure is limited to offmces,
professional or administrative
2 L~ghtlng shall be designed and maintained so
as not to shine on, or otherwise disturb,
surrounding resldentzal property
3 Owner shall comply with the provisions of the
City's landscape ordinance (Chapter 31 of the
Code of Ordinances of the City of Denton, as
amended) upon using the site for an office
4The maxmmum height of any structure shall not
exceed two (2) stories
5 The maximum floor area of the office ms limit-
ed to 1600 square feet
6 Owner shall be lzmlted to one sign, no more
than slx feet (6') tall, with no more than
twenty square feet (20 ft a) of effective area
SECTION II That the City's official zoning map is amended to
show the change in zoning district classmflcatlon
SECTION III That any person vmolatlng any provision of this
ordinance shall, upon convlctmon, be fined a sum not exceeding
$2,000 00 Each day that a provmslon of this ordinance is violated
shall constmtute a separate and distinct offense
SECTION IV That th~s ordinance shall become effective four-
teen (14) days from the date of zts passage, and the City Secretary
is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chronicle, a dally newspaper
published mn the Cmty of Denton, Texas, within ten (10) days of the
date of its passage
