AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM OFFICE (O) AND PLANNED DEVELOPMENT (PD-57) ZONING DISTRICT
CLASSIFICATIONS AND USE DESIGNATIONS TO A NEW PLAIqNED DEVELOPMENT
(PD) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR A 1 059
ACRE TRACT LOCATED IN THE NORTHEAST CORNER OF THE INTERSECTION OF
CARROLL BOULEVARD AND FORT WORTH DRIVE, APPROVING A DEVELOPMENT
PL4kN FOR THE DISTRICT, PROVIDING FOR A PENALTY IN THE MAXIMUM
AMOUNT OF $2,000 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN
EFFECTIVE DATE
W~EREAS, Dennms J Koop has applmed for a change in zoning for
a 1 059 acre tract of land located in the northeast corner of the
mntersectmon of Carroll Boulevard and Fort Worth Drmve from Offmce
(O) and Planned Development zoning classlfmcatmons and use
desmgnatmons to a new Planned Development Dmstrmct (PD) zonmng
classmfmcatmon and use desmgnatmon, and
WHEREAS, on December 13, 1995, the Plannmng and Zonmng Commms-
smon recommended approval of the requested change mn zonmng, and
WHEREAS, the Cmty Council finds that the change in zonmng will
be mn complmance with the Denton Development Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the zonmng dmstrmct classlfmcatlon and use
desmgnatmon of the 1 059 acres of land legally described as shown
in Exhmbmt A, attached hereto and mncorporated heremn by reference,
ms changed from Office (O) and Planned Development (PD-57) zoning
classifmcatmons and use desmgnatmons to a new Planned Development
District (PD) zonmng dmstrmct classmfmcatmon and use deslgnatmon
under the comprehensmve zonmng ordmnance of the Cmty of Denton,
Texas
~ That Exhmbmt B, attached hereto and mncorporated
mnto thms ordinance by reference, ms approved as the Detamled Plan
for the new dmstrmct, mn accordance wmth Dmvmsmon 2 of Artmcle IV
of Chapter 35 of the Code of Ordmnances
S CT_~III That all conflmctmng ordinances, mncludmng
wmthout lmmmtatmon Ordmnance 83-69, are hereby repealed to the
extent of any such conflmct
SECTION IV That the Cmty's offmcmal zonmng map ms hereby
amended to show the change mn zonmng dmstrmct classmfmcatmon
SECTION V That any person violating any provmslon of this
ordmnance shall, upon convmctmon, be f~ned a sum not exceedmng
$2,000 00 Each day that a provmsmon of thms ordmnance is vmolated
shall constitute a separate and dmstlnct offense
~ That this ordinance shall become effective four-
teen (14) days from the date of its passage, and the City Secretary
zs hereby dzrected to cause the caption of this ordinance to be
published twlce in the Denton Record-Chronicle, the official news-
paper of the City of Denton, Texas, within ten (10) days of the
date of its passage
