AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM THE SINGLE FAMILY 7 (SF-7) AND MULTI-FAMILY 1 (MF-1) ZONING
DISTRICT CLASSIFICATIONS AND USE DESIGNATIONS TO THE LIGHT
INDUSTRIAL CONDITIONED (LI(C)) ZONING DISTRICT CLASSIFICATION AND
USE DESIGNATION FOR 5 4912 ACRES OF LAND LOCATED ON THE SOUTH SIDE
OF MCKINNEY, APPROXIMATELY 1,000 FEET WEST OF WOODROW, PROVIDING
FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS
THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the Denton County Public Faczl~t~es mnztzated a
change in zonmng for 5 4912 acres of land from the Smngle Fammly 7
(SF-7) and Multm-Famzly 1 (MF-1) zonmng dmstrmct classmfmcatmons
and use desmgnatmons to the Lzght Industrmal Condmtmoned (LI(c))
zoning dzstrlct classzfmcatmon and use desmgnatmon, and
WHEREAS, on February 14, 1996, the Plannmng and Zonzng Commms-
smon recommended approval of the requested change zn zonzng, and
WHEREAS, the City Counczl fmnds that the change mn zonmng wmll
be mn compliance wzth the Denton Development Plan, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the zonzng dmstrmct classmflcatzon and use
desmgnatzon of the 5 4912 acres of land descrmbed mn Exhmbmt 1 is
changed from the Szngle Family 7 (SF~7) and Multz-Fammly 1 (MF-1)
zonmng dzstrmct classzfmcatmons and use desmgnatzons to the Lmght
Indust'rial Condmtzoned (LI(c)) zonmng dzstrmct class~fmcatmon and
use desmgnatzon under the comprehenszve zonmng ordznance of the
Cmty of Denton, Texas, sub]ect to the condztmon that the property
may ohly be used for publzc bumldmngs and professmonal and
admmnm'stratmve offmces for local, state, or federal governments
SECTION II That the Cmty's offmczal zonzng map is amended to
show the change zn zonmng dzstrzct classzflcatmon
SECTION III That any person vmolatzng any provmsmon of thzs
ordinance shall, upon convmctzon, be fined a sum not exceedlng
$2,000' 00 Each day that a provmsmon of thms ordznance ms vzolated
shall constmtute a separate and distznct offense
SECTION IV That thms ordmnance shall become effectzve four-
teen (14) days from the date of mrs passage, and the Czty Secretary
ms hereby dzrected to cause the captmon of thms ordznance to be
publzshed twmce zn the Denton Record-Chronmcle, a damly newspaper
published in the Czty of Denton, Texas, within ten (10) days of the
date of its passage

ESTABLISHED CONDITIONED LIGHT INDUSTRIAL (LI[C]) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION FOR 64 4155 ACRES OF LAND LOCATED ON
THE SOUTH SIDE OF MCKINNEY STREET AND THE WEST SIDE OF WOODROW LANE,
PROVIDING FOR A SAVINGS CLAUSE, PROVIDING FOR A PENALTY IN THE MAXIMUM
AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN
EFFECTIVE DATE (Z-99-035)
WHEREAS, Joseph Santopetro, on behalf of Denton County, has applied for an amendment
to the conditions of Ordinances 89-171, 92-033, 94-126, and 96-048, which established a
Cond,tloned Light Industrial (Ll[c]) zoning d,stnct classification and use des,gnatlon for 64 4155
acres of land, and
WHEREAS, on May 26, 1999, the Plamung and Zoning Corn,mss,on considered the
mzomng request and based on a 2-2 vote does not forward a recommendation to the City Council
regarding the requested change m conditions of Oldlnances 89-171, 92-033, 94-126, and 96-048,
and
WHEREAS, the City Cooncil finds that the change m the condlt,ons of Ord,nances 89-171,
92-033, 94-126, and 96-048 will be ,n compliance w,th the 1998 Denton Plan Policies, and the 1999
Growth Management Strategies and Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the conditions of Ordinances 89-171, 92-033, 94-126, and 96-048, which
established condit,oned Light Industrial (Ll[c]) zoning district classifications and use designations
for the subject 64 4155 acie property, described in the legal description attached hereto and
incorporated herein as ExNbit A, are amended under the comprehensive zomng ordinance of the
C,ty of Denton, Texas, as follows
a That only public buildings, including correctional facilities, for local, state, or federal
governments and professional and adm,mstrative offices be permitted
b That there will be no curb cuts on Ruddell Street
c That a fence will be erected from Hickory street to the creek along Ruddell Street
SECTION II That the provisions of this ordinance shall govern and control over any
conflicting provisions of Ordinances 89-171, 92-033, 94-126, and 96-048, but all provisions of
Ordinances 89-171, 92-033, 94-126, and 96-048 as they apply to the remaining portion of the zoning
d~stnct land use regulations not herein amended, shall continue in full force and effect
SECTION 111 That a copy of this ordinance shall be attached to Ordlmmce 89-171,92-033,
94-126, and~96~0~8_~showing the amendments hereto approved
SECTION IV That any person violating any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is
violated shall constitute a separate and distinct offense
SECTION V That this ordinance shall become effective fourteen (14) days from the date
of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chromcle, a daily newspaper pubhshed in the City of Denton,
Texas, within ten (10) days of the date of its passage
